MAINE LEGALIZES SAME-SEX MARRIAGE!!!

Governor John E. Baldacci today signed into law LD 1020, An Act to End Discrimination in Civil Marriage and Affirm Religious Freedom.

“I have followed closely the debate on this issue. I have listened to both sides, as they have presented their arguments during the public hearing and on the floor of the Maine Senate and the House of Representatives. I have read many of the notes and letters sent to my office, and I have weighed my decision carefully,” Governor Baldacci said. “I did not come to this decision lightly or in haste.”

“I appreciate the tone brought to this debate by both sides of the issue,” Governor Baldacci said. “This is an emotional issue that touches deeply many of our most important ideals and traditions. There are good, earnest and honest people on both sides of the question.”

“In the past, I opposed gay marriage while supporting the idea of civil unions,” Governor Baldacci said. “I have come to believe that this is a question of fairness and of equal protection under the law, and that a civil union is not equal to civil marriage.”

“Article I in the Maine Constitution states that ‘no person shall be deprived of life, liberty or property without due process of law, nor be denied the equal protection of the laws, nor be denied the enjoyment of that person’s civil rights or be discriminated against.’”

“This new law does not force any religion to recognize a marriage that falls outside of its beliefs. It does not require the church to perform any ceremony with which it disagrees. Instead, it reaffirms the separation of Church and State,” Governor Baldacci said.

“It guarantees that Maine citizens will be treated equally under Maine’s civil marriage laws, and that is the responsibility of government.”

“Even as I sign this important legislation into law, I recognize that this may not be the final word,” Governor Baldacci said. “Just as the Maine Constitution demands that all people are treated equally under the law, it also guarantees that the ultimate political power in the State belongs to the people.”

“While the good and just people of Maine may determine this issue, my responsibility is to uphold the Constitution and do, as best as possible, what is right. I believe that signing this legislation is the right thing to do,” Governor Baldacci said.

117. Even if there is no referendum
this law would not take effect until some time after the Legislature is out of session. As I recall, it would be September at the earliest.

To force a referendum would only take about 50,000 signatures, I'm fairly sure that the opponents will get them, forcing deferral of this taking effect until after November balloting.

But, I have faith in the good people of Maine, and look forward to watching fundie heads explode when they see the first time the people of a state have affirmatively ratified equal marriage!

For now, I think we should try to focus on getting this done at the state level, preferably by legislatures and voters, but also by way of state courts, if possible.

The US Supreme Court will eventually have to intervene to urge along the Mississippi's and Alabama's of the country.

119. At this point, that doesn't look good
I can see in about five years or so, perhaps ten to fifteen states will have equal marriage laws on the books. We still have about thirty that have discrimination staining their constitutions, and I cannot see reversal in more than a very few of those cases, like CA, OR, and MI, for instance.

At the time the Supreme Court threw out bans on interracial marriage with Loving vs. Virginia, only a handful of places had these ugly laws, and they were spottily enforced, if at all. They also dated from a hundred years earlier, enacted after the Civil War. Today's bans on equal marriage are fairly fresh law, enacted by votes of the citizens of the states where they exist.

It's going to be tougher for the Supreme Court to override that, especially since the only replacements President Obama is going to make are just going to be for votes we had anyway. We really don't want a full Supreme Court decision coming down that has the power of stare decisis for years to come.

Full faith and credit is probably the way to go. Right now, about half of the states allow first cousin marriage, and half don't. First cousins who marry in a state where that is allowed are entitled by FFC to have their marriages recognized by a state they move to that would not have allowed them to marry. We can live with that for awhile, while waiting for older fundies to die off.

I want to punch people who think that their religion trumps mine. Why should YOUR religious beliefs prevent my friends from getting married who don't share them, and in fact belong to a religion that supports them and their choice to marry.

Bingo. I can't fucking stand these people who insist others, often outside of their religion, pay the price for their religious beliefs. It's the same for abortion, contraceptive prescriptions, any sort of sexual self expression and not to long ago, interracial marriage, women's suffrage or integration.

time they collected signatures they fell way short. Hopefully the same thing happens this time and it never gets on the ballot. If it does, we can outwork the wingers and win the vote.

and to be honest, the language was REALLY confusing on the ballot question. I can imagine 2% filled in yes when they meant no.

The language that appeared on the ballot:

Do you want to reject the law passed by the Legislature and signed by the Governor that would ban discrimination based on sexual orientation with respect to jobs, housing, public accommodations and credit?

This legislation amends the Maine Human Rights Act to make it unlawful to discriminate against individuals based on their sexual orientation in decisions regarding employment, housing, access to public accommodations and the extension of credit. Religious organizations are exempt from this new provision.

This legislation was approved by the Legislature and signed into law by the Governor in May, 1997. Petitioners subsequently collected a sufficient number of signatures of registered voters to refer the legislation to the people for approval or disapproval at a statewide election. Its effect has been suspended pending the outcome of the election.

A "YES" vote is in favor of the people's veto and disapproves the legislation.

A "NO" vote is in opposition to the people's veto and approves the legislation.

How dangerous will this be?

I guess at worst, it pushes the issue to the USSC even faster. If two states have stripped a group of their civil rights, that may mean the final arbiter is the USSC. I'd love to see them rule on that issue: how can people at the ballot strip civil rights (which are inherent in the law, and don't come from the law, but before the law) by majority vote?

40. New Hampshire decision coming soon too
Today, the NH House will vote to concur with the amendment made to the gay marriage bill by the Senate. If they do, the bill will go to Governor Lynch today, and he'll have five days to sign it. I'm listening to a live stream of House proceedings right now, and I'll keep everyone posted.

I cannot believe the idiots in my so-called progressive state did not sanction equal rights before the rest of the country! (and is trying to do the opposite, no allusions to Myth California USA and her "opposite" marriage.) The only thing I can say is that my FABULOUS city did get the train rolling in 2004 when our mayor opened City Hall to same sex couples. But seriously, whatever it takes to give constitutional rights to ALL American citizens, I don't care about the order. I just want the reactionary fundies to go the f@#$ away and let equality reign. I wonder how many states will join the group of states that allow same sex marriage? I'm going to take a blind guess at about 1/3 of them for the immediate future. That should be about 17. We'll see. Others will slowly join over time. There will be some very long time holdouts.

that marriage rights for gay and lesbian citizens is not a religious issue but a civil issue. Churches, synagogues, mosques, temples, etc. may decide whether to confer spiritual recognition of a same-gender communion but it is not the place of citizens of any religion to deny the civil rights of another.

Good for Maine. Alas I live in Georgia so until I move away or the U.S. Supreme Court issues a favorable ruling on the issue this will not be an option for me. But I am so happy for those across this country that now enjoy equal civil rights and have their relationships, both the rights and responsibilities, legally recognized.
