Deportation Nightmare: Eduardo Caraballo, US Citizen Born In Puerto Rico, Detained As Illegal Immigrant

Huffington Post | Updated: 05-25-10 05:46 PM

Eduardo Caraballo, a U.S. citizen born in the United States, was detained for over three days on suspicion of being an illegal immigrant. Despite presenting identifying documents and even his birth certificate, Caraballo was held by federal immigration authorities over the weekend and threatened with deportation, according to an NBC Chicago report.

He was only released when his congressman, Luis Gutierrez -- a vocal supporter of immigration reform -- intervened on his behalf. Caraballo was born in Puerto Rico, making him a natural-born citizen of the United States. He moved to the mainland as an infant, and now lives in Chicago.

Last week, NBC reports that he was arrested in connection with a stolen car in Berwyn. Caraballo maintains his innocence. In any case, when his mother posted bail on Friday, he was not freed. "Instead of being released, he was told by authorities that Immigration and Customs Enforcement was detaining him because he was an illegal immigrant," NBC reports.

Caraballo spent the weekend in the custody of federal immigration agents. When he presented them with ID and his birth certificate, he says officials were skeptical: "Because of the way I look, I have Mexican features, they pretty much assumed that my papers were fake." Only after his congressman interceded was Caraballo set free.

4. The people of Arizona will be pissed that the Feds let this guy go and didn't
ship him back to .....................never mind!

What a waste of resources this new AZ law will cause.

By the way, I'm scratching my head about why the Feds in Illinois are carrying out the wishes of the legislature and Governor of Arizona. This insanity seems to be contagious!!!

5. Well, I think Eduardo Caraballo is preparing to sue the feds
...so Arizona can get in on this if they want to. But I'm wondering if any insurance company will provide Arizona with liability coverage for the inevitable lawsuits that will come.

- Hell, they might even have to raise taxes in Arizona to cover the lawsuit expenses.....

10. Puerto Rico's a foreign country. Just ask GOP candidate Vaughn Ward.
During a debate last week, Ward seemed to suggest that Puerto Rico is a country. It isn't, of course. It's a U.S. territory. Ward opponent Raul Labrador -- who was born in Puerto Rico -- called Ward out on the apparent error.

"Puerto Rico's not a country," Labrador said. "Puerto Rico's a territory of the United States. It's about time that we took some civics lesson and learned what Puerto Rico is."

Ward: "I really don't care what it is. It doesn't matter."

"Obviously you don't," Labrador said.

37. Need to go back another 200 years, New England Confederation 1643
It was particularly strong among the Puritans in New England, who saw themselves as being superior to all others, essentially God's chosen people for the New World. Increase and Cotton Mather preached it and most everything seen since began in New England before 1650.

This went far beyond simple race, although that was a large component, but included anti-Catholic and anti-Jewish components, anti-Irish, etc. WASP small town New England land owners (men only) at the top of the heap.

Fugitive Slave Act was important for the North because if justified denying full rights to Free Negros, more commonly practiced in the North than in the South.

41. The issue is not why he was arrested, the issue is why he was detained after bail was posted.
It's hard to see how that was anything but racial profiling.

in Arizona, police could be picking up people for "looking foreign". It's not really the same as what happened here.

And we only know the stolen car charges, we don't know what happened.

48. I'm not suggesting it's not profiling,
but it's one thing to hassle someone over immigration that you've already arrested on other charges, it's another to randomly pick a law-abiding face out of the crowd and do it.

Edited on Thu May-27-10 03:03 PM by EFerrari
I think I see what you're saying. But it seems to me to be a distinction without a difference.

It is different for someone to be hassled first about immigration rather than later. But it's not much of a difference considering how many people are hassled daily for other bogus stuff.

50. I guess here's the difference as I see it.
It wouldn't be "racial profiling" if they checked everyone but,

Would it be okay if police checked the immigration status of every single person they came across, regardless of whether they were doing anything illegal?

Would it be okay if the police checked the immigration status of every single person they arrested?

In the first instance (leaving aside the impracticality of it all), they're asking for "your papers" when they have no business stopping you at all.

In the second instance, they've already arrested you on some other charge, and processed you, and they're just adding this extra hassle.

I would.

I mean I've joked on this board about going up to Arizona getting arrested under their new law and then filing a lawsuit for wrongful detainment, but Mr. Caraballo had identification proving he was a citizen and they kept him locked up anyway.

That's mindboggling and I hope he sues and wins.
