Lawyer Believes Yee, Cleared of Spy Charges, Is Being Silenced

April 21 — Capt. James Yee's bizarre journey through the military justice system — from suspected al Qaeda spy to accused adulterer to free man with a clean record — has taken a new confounding turn. Yee has apparently been commanded to keep silent about his ordeal.
Earlier this month, Yee received an order from his commander at Fort Lewis, Wash., Army Lt. Col. Marvin S. Whitaker, regarding Yee's "First Amendment rights to free speech."

The letter, received on April 6, informed Yee that as a soldier he is ordered — with threat of punishment under the Uniform Code of Military Justice — to refrain from any speech violating what sound like fairly vague and malleable criteria.

"Speech that undermines the effectiveness of loyalty, discipline, or unit morale is not constitutionally protected," Whitaker wrote. "Such speech includes, but is not limited to, disrespectful acts or language, however expressed, toward military authorities or other officials."

Yee is also barred from any "(a)dverse criticism" of the Department of Defense "or Army policy that is disloyal or disruptive to good order and discipline."

10. After merely an hour research, I believed he had evidence of torture.
I researched his background which indicated no reason to believe he was guilty of any of the charges initially positioned against him. That led me to believe that he had gathered evidence of torture. Now that we all know some of the "torture techniques" include rape, the pornography allegation seems all too tenuous.

5. I'd bet more that his 'pornograhpy' was pix of softening up POWs
Mostly Innocents In Gitmo from the looks of it.

come to be applied to "dissenting" people working in Gitmo ...

9. Actually other duers have previously suggested it
seemed to make alot of sense to me as the charge of possessing porno always struck me as odd.

1) he was stationed at Gtmo.
2) there are rumors of war crimes at Gtmo. (e.g prisoner abuse)
3) taguba's(sp) report was classified as "secret".
4) he may have had information relating to prisoner abuse
which was classified; and so he was arrested on the charge of having classified info.

12. Hillary pointed out the discrepancy in DOD publicly leaking details about
this man's case prematurely, but Rummy using the excuse that they didn't share more info about the charges against the Abu Ghraib soldiers due to concern that disclosure would hurt the prosecution against them. I was surprised to hear Greta Van Susteren on Fox mention this inconsistency brought up by Clinton in the hearing.

Makes sense that they conviscated evidence he had of prisoner abuse, hushed him up and purposely made his case widely know publicly in order to send a message to intimidate any others in a similar position who might have damning info about what has been going on.
