Bush, Dems Reach Deal on Appointments

WASHINGTON - Breaking a months-long impasse, the White House and Senate Democrats on Tuesday struck a deal allowing Senate confirmation of dozens of President Bush's judicial nominations in exchange for a presidential promise not to bypass the Senate again this year.

Under the agreement, Democrats will allow votes on 25 non-controversial appointments to the district and appeals courts. In exchange, Bush agreed not to invoke his constitutional power to make recess appointments while Congress is away, as he has done twice in recent months with judicial nominees.

Owen, Kuhl, Brown and other judicial nominees Democrats found objectionable are not part of the impending deal, Daschle said. White House nominees for positions outside the federal courts also are not part of the deal.




I think this may be a rare win for the Dems….though a part of me still wants to say fuckem….

As far as I know, ther's no way to hold him to it! There's no honor amoung thieves.

However....it's still a Dem win if they handle it right.

Keep it on the front burner and YELL IT from every mic in the world if Shrub doesn't comply.

Annouce NOW how wrong the Pubs are when they accuse the Dems of obstructionism....see this is what we did!

Around 2002, everyone on DU seemed to be screaming "But we gotta save the courts!" at every minute scrap of criticism leveled at a Dem. And I knew at the time it was crap, because ... well, y'all know the Bush-Gore 5, right? All of them were either unopposed by Democrats (unanimous votes) or passed by a Democratic margin (i.e. the Dems had the numbers to block them).

The party's made bloodless milquetoasts the ideal. Wouldn't want to look too "red meat". Yessir, we'll stick to the solid foundation of gentility and compromise that won over all those voters in landslide numbers in 2002 ...

Senate Republican leaders are considering rewriting the chamber’s rules to limit what they call Democratic obstructionism that has slowed the pace of work in the Senate to a trickle.

In particular, Republicans want to eliminate the ability of Democrats to filibuster consideration of the president’s executive and judicial-branch nominees, as well as bar filibusters that block the naming of conferees prior to House and Senate negotiations.

To do so, Senate GOP leaders are considering resorting to what they call the “constitutional option” and what Democrats deride as the “nuclear option” because they charge it would amount to a Republican declaration of all-out war against them.

Republicans say they must take drastic action because Senate Minority Leader Tom Daschle (D-S.D.) has put a freeze on all judicial branch nominees and has vowed to allow conferences to go forward only on a case-by-case basis.

After the large group of nominees are voted on and confirmed, Bush* will send up one of the wing-nuts and the Dems will object. After much flapping around, they will fillibuster the nomination. The Repugs will use the echo chamber to advance the meme that it's the Dems who are breaking the agreement. (They will say that Daschle was wrong about those disputed nominees being included and that there was never any deal about them. They'll say, "Daschle said that. WE never said anything about that."

Then Bush will recess appoint the wing-nuts. Voila! He gets everything he wants, and the Dems will be left sputtering.
