BOSTON - The Massachusetts attorney general said Friday that he has warned clerks in four communities to stop issuing marriage licenses to out-of-state gay couples.


"Let me make it very clear here: If there are violations of the law, the law will be enforced," Attorney General Thomas Reilly said


Officials in Provincetown, Somerville, Springfield and Worcester have openly defied Gov. Mitt Romney's order not to let nonresident same-sex couples marry.


Acting on a request from the governor, Reilly sent letters to the clerks. He said he shares Romney's interpretation of a 1913 Massachusetts law barring couples from marrying in Massachusetts if their union would not be recognized in their home state.

2. That law was intended to keep interracial couples from marrying in MA.
It was a stupid law then, and it's a stupid law today! The only way MA can enforce this stupid law is to void ALL marriages between people who crossed state lines to marry between 1913 and today!

Ashcroft was ising a law fron 1879 prohibiting brother owners to approach ships to prosecute Greenpeace (lost).
Do I see a patern here?

Doesn't the MA law run counter to the full-faith-and-credit clause of the federal Constitution?

4. I doubt the courts will uphold this law.
I think that it's clearly discriminatory to enforce this policy. There are different state-by-state guildelines on heterosexual marriage as well, but they are aren't diggin around on these issues, now are they?

Run to the courthouse and file a lawsuit! Who cares if you lost? File a lawsuit so you can slap a patina of legality on your crime, and just steal the result back.
