Spammer Sentenced to 7 Years in Prison
A man who sent 850 million junk e-mails through accounts he opened with stolen identities was sentenced to up to seven years in prison on Thursday.

Atlanta-based Internet service provider Earthlink Inc. said it hoped the sentence and an earlier $16.4 million civil judgment against Howard Carmack will deter other spammers.

"Before spammers send one more spam e-mail, we think they should remember that what happened to Howard Carmack can happen to them," said Karen Casion, Earthlink's assistant general counsel.

Jurors sentenced Carmack to seven years for convictions in March of forgery, identity theft and falsifying business records. He must serve a minimum 3 1/2 years.

1. good. fry these people's asses. i get 150 spams per day even AFTER my
spam filter processes them. it's completely ridiculous.

Sheesh. Let's save jail space for dangerous people and fine the crap out of the spammers instead. I mean, spam's annoying, but it never killed anyone.

9. These people cost the economy $billions/year in lost productivity,
and adversely affect 100s of millions of people. I think the penalty should be higher.

They won't really take up too much jail space, because most spam originates from a limited number of major offenders.

I think it's a fine penalty for the crime, but as much as the jails are overcrowding (1 in 75 men), there should be a very stiff fine.

Like $7 million.

WASHINGTON - One week before George W. Bush's now-famous sale of stock in Harken Energy Corp. in 1990, Harken was warned by its lawyers that Bush and other members of the troubled oil company's board faced possible insider trading risks if they unloaded their shares.

The warning from Harken's lawyers came in a legal memorandum whose existence has been little noted until now, despite the many years of scrutiny of the Bush transaction. The memo was not received by the Securities and Exchange Commission until the day after the agency decided not to bring insider-trading charges against Bush, documents show.

It appears that Mr. Bush had insider information, that he was told that such insider information could be considered material, was given express warnings about what the consequences could be.

The memo, a copy of which was obtained by the Globe, does not say directly whether Bush would face legal problems if he sold his stock. But it does lay out the potential for insider-trading violations by Bush and other members of the Harken board, and its existence raises questions about how thoroughly the SEC investigated Bush's unloading of $848,000 of his Harken stake to a buyer whose name has not been made public.

The SEC cleared Bush after looking into whether he had insider knowledge of an upcoming quarterly loss at Harken. But the SEC investigation apparently never examined a key issue raised in the memo: whether Bush's insider knowledge of a plan to rescue the company from financial collapse by spinning off two troubled units was a factor in his decision to sell.

Martin Grass directed a four year accounting fraud that cost investors many millions of dollars and erased 1.6 billion in profit from the company....

Seems to me that the scales of justice may be a little tilted here-

Instead of jail, he should be sentenced to sit at our mail servers at work and clear out the thousands of spam messages that is killing our productivity.

Oh yes, and Carmack reply to his sentence? He told the judge he believed the case against him was overblown, saying there were no victims. Frickin' Idiot!

He will never do a day of time. See, I know Kenny-Boy. I used to fly a LearJet 55 and Lockheed JetStarII for Kenny-Boy (slightly pre-Enron). I know Kenny-Boy and all his "family" problemo's. And I know when, at an earliest date, Ken Lay knew GW. It is an early 80s date. That makes both of them, or DemoTex, liars. Thrust whom?
