Standing Up to the Schoolyard Bully
U.S. Congressman John Olver (D-MA) said recently that he
"is deeply concerned whether we will actually have an election in Nov. '08, as he believes this administration will likely strike Iran from the air, declare a national emergency, and cancel the '08 elections".
As Ralph Nader describes it, Olver and the rest of Congress are afraid that -- if Bush or Cheney are impeached -- they might declare martial law and suspend the 2008 elections:

1. Lets try it. Impeach them. IF they refuse to comply send in the National Guard.

8. Bush could easily federalize all National Guard forces in one second
in a state of emergency or state of war, he has absolute executive power to do so, and the governors of the states can't stop him.

2. Somewhere, I'm not sure whether it was here or not............
I mentioned that maybe the performance of the dems is as lacklustre as it has been because lawmakers are the first to know when a society is doing the fascist shift...and how much there is to lose.

This is in that vein.

Clearly, these crimes cannot be tolerated or it will be the norm in the future.
Let's walk through this:
Martial law is declared by the executive branch.
WHO sends in the National Guard? What are the legal options here?
I am interested in an educated (legal) speculation on this scenario because I believe in facing things before they happen.

10. Exactly. And if they declare it, how does that prevent them from
being impeached? Congress can still remove him from office.

11. they'll probably prefer to be impeached
cause if they did declare martial law and try to shut down the country, there's a good chance the pitchforks and torches will come out and the white house would be stormed. i doubt that he's ever read history, but bush would be well served to keep in mind what happened to mussolini when people turned on him.
