The Nuremberg Defense will not work, the soldiers need an "Abu Ghraib"
Defense.

Here is how the lawyers will have to defend their clients:

The civilian interrogators set up a systemic program of abuse on all levels such that not only were detainees subject to abuse, the military personnel were as well.

The military personnel were frightened into obeying their masters, the civilian interrogators, with verbal and mental abuse including threats of "shipping their asses to Gitmo as Enemy Combatants if they refuse to follow orders".

The only way these people will be able to alter the Nuremberg Defense in such a way as to make it work is to become victims alongside the Iraqi Detainees. Anything else, and they are war criminals.
