Pat is right about this (excluding his "white people" observation). This is the beauty of the constitution that those wishing to reign in "activists judges" don't get. In this country, everybody's rights are protected, even if a majority wish to deprive you of them. This is exactly why courts are ruling against sodomy laws and for equal access to marriage, for example.

It's the Constitution itself which is provides a check to "unrestricted democracy", assuming it would ever be practical to vote on every new law.

As we saw in 2000 the SCOTUS failed miserably when protecting our rights in that capacity.
