Congressional Accountability for Judicial Activism Act of 2004

H. R. 3920
To allow Congress to reverse the judgments of the United States Supreme Court.

March 9, 2004

The Congress may, if two thirds of each House agree, reverse a judgment of the United States Supreme Court--

(1) if that judgment is handed down after the date of the enactment of this Act; and

(2) to the extent that judgment concerns the constitutionality of an Act of Congress.

Alright, why haven't I seen any screams over this one? Look at bullet #2 "to the extent the judgment concerns the constitutionality of an Act of Congress." The whole point of the judiciary is to evaluate the constitutionality (and subsequent lawfulness derived through stare derisis); that was never given to Congress precisely because they're not in a position to understand the subtle details of "constitutionality."

This is an absolutely absurd, and highly dangerous, bill.

3. I could think of ONE Supreme Court (lack of) judgment that should be......
...overturned. (12/12/2000) But yes, it would be a dangerous and seriously unconstitutional precedent to pass such legislation.

5.  Traitors
At least we now have a partial list of traitors to go on.

Rep. Ron Lewis,Ky. introduced the bill

Sent a letter to Jim Kolbe, he represents my district here in AZ. I told him that anyone who supports this bill, were traitors.

10. Exactly.
Law cannot have paradoxes. This would create a cycle, precisely constructed in the Constitution to avoid this kind of nonsense.
