I am referring to the 2nd batch.....whatever came of that? ACLU lawsuits....and then...what?

I was just wondering that myself recently. What's with the ACLU? They're spearheading the lawsuit, aren't they? The deadline has come and gone and still not a peep.

15. Apparently, Roberts made a statement saying that it was more
important to get the report right than to do it on time, or words to that effect. The latest I could find on it is discussed here:

My feeling is that there is something (probably a lot of things) that they don't want us to know and that's why they are stonewalling it.

7. Restarted the clock at the last hour
They were appealed out of Judge Hellerstein's court and into the 2nd appeal's court. Last I read the DOD lawyers had filed an intent to appeal, which apparently starts the clock ticking again with a brand new panel of judges who need to be empaneled etc.

The good news is supposedly no FOIA request has ever made it past the federal appeals court level, so whatever the decision is, will probably be this panel of judges at the 2nd appeals court.

There's a good diary at KOS that is usually updated when there is new information, the writer has a CourtWeb subscription and watches the rulings.

8. The junta keeps defying the courts
The courts, to save face, have issued a few delays after the junta has refused to release the photos.

Pretty soon the court is going to get sick of looking that toothless and silly. Then we may see some action.

10. Last I heard...
The federal court originally ruled on Sept. 29 that the Defense Dept. had to release all the Abu Ghraib documents. The Defense Dept. then filed a "motion to reconsider" asking the judge to change his ruling, but the judge denied that motion. However, he did allow one final extension until Nov. 15 for the government to either release the documents or appeal to a higher court. That's it - that's the last court record. Nov. 15 was the official deadline - I have no idea if the gov. actually appealed or just ignored the ruling. And apparantly no one in the media is asking them about this.

14. I looked last week for new info on the aclu website, but nothing
As I followed it, they missed their last official deadline, and then the judge gave them another week, which would have been Thanksgiving. I thought they'd wait and do a news dump over that holiday hoping none of us would bother our beautiful minds with it. But it seems to have just gone down the memory hole.

I spoke with the ACLU this morning and found out that the Federal Government will appeal Judge Hellerstein's ruling that selected Abu Ghraib photos should be released.

What were you thinking's diary :: ::
The Department of Defense lawyers notified the court yesterday of their intent to appeal to UNITED STATES COURT OF APPEALS FOR THE SECOND CIRCUIT. The ACLU indicated that it would be unusual for a FOIA lawsuit to go beyond the Appeals court so that the final decision should made by a panel of judges to be selected.


They didn't rule out the possibilty that the government would try to stall and file a further appeal with the US Supreme Court should they lose at the Circuit Court Level.


All in all it looks like we will have to wait for another decision.
