5. It would still be illegal
The 4th Amendment states very clearly:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

So even if they pass a law, the law is unconstitutional and any act committed in the name of that law is STILL ILLEGAL. I thought they cleared all this up in like the first 25 years of our nation's existence. And isn't this type of thing taught in HIGH SCHOOL government classes? So why does the administration not get it? Better yet, what do they get out of it? An oppressed, ARMED society is not one easily reckoned with.

He doesn't need a statute. He does it, congress ignores it, it's all good.
