Boxer Asks Presedential Scholars About Former White House Counsel's Statement that Bush Admitted to an 'Impeachable Offense'



December 19, 2005

Washington, D.C.– U.S. Senator Barbara Boxer (D-CA) today asked four presidential scholars for their opinion on former White House Counsel John Dean’s statement that President Bush admitted to an “impeachable offense” when he said he authorized the National Security Agency to spy on Americans without getting a warrant from a judge.

Boxer said, “I take very seriously Mr. Dean’s comments, as I view him to be an expert on Presidential abuse of power. I am expecting a full airing of this matter by the Senate in the very near future.”

Boxer’s letter is as follows:

On December 16, along with the rest of America, I learned that President Bush authorized the National Security Agency to spy on Americans without getting a warrant from a judge. President Bush underscored his support for this action in his press conference today.

On Sunday, December 18, former White House Counsel John Dean and I participated in a public discussion that covered many issues, including this surveillance. Mr. Dean, who was President Nixon’s counsel at the time of Watergate, said that President Bush is “the first President to admit to an impeachable offense.” Today, Mr. Dean confirmed his statement.

This startling assertion by Mr. Dean is especially poignant because he experienced first hand the executive abuse of power and a presidential scandal arising from the surveillance of American citizens.

Given your constitutional expertise, particularly in the area of presidential impeachment, I am writing to ask for your comments and thoughts on Mr. Dean’s statement.

Unchecked surveillance of American citizens is troubling to both me and many of my constituents. I would appreciate your thoughts on this matter as soon as possible.

I am a long time admirer and I hope you will run for President in 2008 so I can vote for you.

I am responding to your request for comments on Bush's public confession yesterday. Indeed, he made it very clear that he has committed impeachable violations of the Constitution (in this case, the 4th Amendment) as well as Title III and FISA. He also made it clear that he will continue this crime spree until he is removed from office. It is very much time to call for his impeachment. This is only the latest in a series of high crimes he has committed, including lying to Congress to sell his illegal war.

However, it is possible that the GOP will feel compelled to impeach W. before the election in order to retain control of the House, since, if enough good reasons are found to impeach him and nothing is done about any of them, this in itself could swing the vote (as the Dems well know).

On Sat. Dec 17, 2005 the president of the United States of America boasted that he authorized illegal wiretaps for the purpose of spying on U.S. citizens. This is a blatant violation of my civil rights as expressed in the Constitution of the United States. This is the same Constitution that every president before him has sworn on the bible to uphold and defend.

With his admission, he arrogantly disdains and dismisses my rights, your rights, and the rights of the very soldiers that he commands this day. His irrational thought process seems to say that “In order to preserve your civil liberties, freedom and privacy, your civil liberties, freedom and privacy must be covertly undermined.”

Our president cries out that in the reporting on his heinous activities, the free press aids terrorists and other enemies of this country. I do not see how this is possible. Enemies of the United States should always fear her and expect her full and purposeful attentions. What I do not understand, is how riding roughshod over the precious liberties, freedoms and privacies of our citizens can be seen as a net gain for the defense of our country.

The president’s outrage at having his covert activities exposed seems opportunistic, self serving and duplicitous. His claim that disclosing these activities may harm national security seems oddly incongruous in light of the allegations that someone on his senior staff was directly involved in disclosing the identity of a CIA agent for political hay making. Indeed. The vice presidents chief of staff has been indicted for lying to a grand jury about this disgusting affair.

Finally, congressional investigations intended to provide transparency and a means for objective evaluation of our government and its administration have been suppressed and stalled. But here is our president, arrogantly spying on American citizens with usurped impunity. The presidents lying and rank hypocrisy has given even members of his own party reason to pause and question the legitimacy of his actions.

I am writing to ask that you support articles of impeachment against President George W. Bush. I do not make this request lightly. Would it be better to impeach Bush now, or wait until after the '06 election and impeach both Cheney and Bush thus putting a Democrat in the White House? I think they might want us to impeach him now so Cheney becomes, in fact, president.

You're forgetting who's in control of EVERYTHING. Bush could commit murder and they wouldn't impeach him with who's in charge now. Most elected Republicans don't have the integrity to do what we all know is right, they just have their party loyalty.

They have also conspired to break laws, violate the Constitution of the United States and to cover-up those illegal activities.

They should be charged, convicted and jailed for the rest of their natural lives. Let's also take everything they have via a humoungous restitution order and return it to the families of soldiers lost or disabled by this war of false pretenses.
