At issue in this dispute between the US and twelve other WTO Members is the Continued Dumping and Subsidy Offset Act ('CDSOA') of October 28, 2000. The CDSOA amended the US Tariff Act of 1930 so as to provide for a system whereby US Customs will annually distribute, after liquidation, duties assessed pursuant to a countervailing duty order, an antidumping order, or a finding under the US Antidumping Act of 1921 to (certified) domestic producers which supported the petition for the countervailing duty order, the antidumping order, or the finding under the US Antidumping Act of 1921. There is no statutory or regulatory requirement as to how to spend a disbursement; the CDSOA distributions to "affected domestic producers" made as of December 2001 totaled over $206 million. The Panel found that the CDSOA is inconsistent with Articles 5.4, 18.1, and 18.4 AD Agreement; Articles 11.4, 32.1, and 32.5 SCM Agreement; Articles VI:2 and VI:3 GATT; and Article XVI:4 WTO Agreement. According to the Panel, the CDSOA nullified or impaired benefits accruing to the Complaining Members under the AD Agreement, the SCM Agreement, and the GATT to the extent that the CDSOA is inconsistent with those agreements. The US appealed the Panel report.

24. He is talking about the 'Byrd amendment'
The amendment that allows that when unfair trade has resulted in tariff revenues, the revenues go to the companies harmed by the 'unfair trade'. The repubs want the monies accrued to go into the general revenues of the government.

You can probably expect a transcript here but I don't see one yet. I am also interested in seeing a re-run of the speech. I guess I've missed it, since CSPAN 2 just has Grassley telling what a great idea it is to gut Medicade in order to partially fund even more tax cuts for the wealthy elite.

31. Politicians fail to protect American jobs
I don't know if anyone is still following this thread, but I have some relevant information to share. The Byrd Ammendment mentioned earlier is probably not the one that directs tariff collections toward companies who are harmed by violations of our international trade agreements. I believe the Senator was talking today about the Byrd Amendment to this year's Senate Bill 1932, which would have stopped an additional 350,000 additional immigrant H1B visas from being issued each year. In case you have been in a coma for the last 50 years, Republicans have been supporting anything and everything that will replace American jobs with cheap labor, either here or overseas. The H1B visa program is but one example of this endless assault on what is left of our middle class.

Last week, the Senate voted overwhelmingly -- 71-20 -- to back the Continued Dumping and Subsidy Offset Act (CDSOA), more commonly called the Byrd Amendment. But, in the final budget package negotiated between the House and Senate Republican Leadership, the CDSOA is repealed after two years.

“CDSOA was enacted to restore conditions of fair trade, so that jobs that should stay in the United States are not destroyed by unfair foreign competition,” Byrd stated on Tuesday. “Now is the time to hold foreign unfair traders more accountable, not less! There is no need to repeal the law today, two years from now, or ever.”

“If our trading partners don’t like this trade law, the solution is not to repeal the law. If our trading partners are offended by the law, I have only two words for them: Stop dumping!” Byrd argued.
