8. Constitutional issue...
He can't be tried in a regular court of law according to the Constitution. He has to be impeached and removed first.

But, he does have a few scraps of decency in his body.

Hagel has received a 100% score from the Christian Coalition and 0% from NARAl.

4. There Should Be A Forced Closed Session Again...
I agree with Senator Boxer that the priority on setting up a true partisan investigation of this regime's illegalities should commence immediately after the Xmas break (look for Frist to try to put that off until October) and before anything is said or done on ScAlito.

If I were king of the forest, I'd either do another closed session meeting on the Senate floor...forcing all the Senators into the chambers (they sure hate that) and to force them to shut-up and listen...and then get them on record about where they stand on this.

If that's not enough to shake some of the "moderate" Repugnicans loose, then Senator Reid should prevent a quorum...similar to what occured in Texas...making sure there's not enough Democrats at votes that will prevent anything from getting done. Yes, a shutdown...but one that is worth the gamble...and not a filibuster. It will also seperate the Democrat wine from the swine...those "with us" and those who aren't.

5. I hate to split hairs here
but acknowledging the existence of the 4th Amendment isn't sufficient to make one a moderate. The Republicans calling for an investigation are still quite conservative, just not Commander Koo-Koo-Bananas conservative.
