LAT: Officials Fault Case Bush Cited as Excuse for Spying
...In his radio address Saturday, Bush said two of the hijackers who helped fly a jet into the Pentagon — Nawaf Alhazmi and Khalid Almihdhar — had communicated with suspected Al Qaeda members overseas while they were living in the U.S.....

But some current and former high-ranking U.S. counter-terrorism officials say that the still-classified details of the case undermine the president's rationale for the recently disclosed domestic spying program.

Indeed, a 2002 inquiry into the case by the House and Senate intelligence committees blamed interagency communication breakdowns — not shortcomings of the Foreign Intelligence Surveillance Act or any other intelligence-gathering guidelines.

The officials from U.S. intelligence, law enforcement and counter-terrorism agencies said they agreed to discuss the case — and Bush's reference to it — because they did not believe it supported the administration's position that the FISA court should be circumvented in certain high-profile and urgent terrorism cases.

"It's total hubris. It's arrogance by the people doing this," said a second senior U.S. counter-terrorism official.....

3. All the print press has faults, but LA Times does some valuable reporting.
Their article about the NYT holding the spy story until after the 04 election was also really valuable.

4. One thing I've been trying to figure out from Shrub talking about this
was he saying that he had to break the law to get the info that these guys were talking (which means he knew more about 9/11 before it happened then they've ever admitted, please explain why you didn't stop it)

or

Was he saying that if he had broken the law, they'd have listened to those phone conversations and stopped 9/11 from happening? (If you knew enough to think that you would have monitored those conversations, why didn't you stop them from getting on that plane?)

I know Shrub was trying to pound the 9/11 drum once again - but I'm at a loss as to how he thought bringing up those phone conversations doesn't make him look worse either way.

5. His actions are illegal and his excuses are bullshit.
All those involved in this activity should be taken into custody immediately because THEY COMMITTED A FEDERAL CRIME!!!

This isn't a dictatorship, damnit, it's a democracy where the rule of law applies. Right? Right?
