10. Really? I didn't know that. I thought I heard that Frist was going to use

it if the Dems tried to Filibuster this defense bill and that is why Cheney was called back? OK, I can't keep track of this crap anymore. It must have been in regards to Alito. :crazy:

11. Well ,technically it could be used

at any time, yea. But the justification for its usage in judicial confirmations was that the filibuster violated the Constitution if applied to such confirmation votes.

Moderate Repubs were balky rnough as it is for that one, so there's no way they'd go for the nuclear if a filibuster is used this way.
