Courts unlikely to hear wiretap cases, legal scholars say
The reason: Most suspects won't know phones were tapped
By Richard Willing
USA TODAY

Are warrantless wiretaps of domestic targets suspected of terrorist activity legal if the surveillance is approved by the president?

That question, raised by the disclosure of a secret National Security Agency program to eavesdrop on the phone calls and e-mails of terrorism suspects in the USA, is unlikely to be answered in a court of law, according to lawyers, legal scholars and security specialists.

The reason: The surveillance is so secret that its targets are unlikely to know they were wiretapped and thus are unlikely to raise a court challenge. That leaves the legal underpinnings of the program to be debated in Senate hearings expected to begin in early 2006.

4. I heard that the ACLU is going to cover that issue.
I thought I saw a link here yesterday and may of got an email as well......I think taking my lead from John Conyers, Howard Dean and the ACLU will keep me on task. This is definitely the next step, identify the victims. I truly believe they used wiretaps to spy on Democrats, activist and especially into campaigns.

Does anyone recall the problem where the Congressional republicans say they "accidentally downloaded the Democratic Congressional documents? I wonder if this is part of the scheme. Also, I recall Democratic Headquarters around Ohio getting broken into....computers and data were stolen.......

Is there a connection?

3. There is no list
That's the reason they did not go through the FISA court- so there would be NO record of who they were spying on. WHY??? Because they were spying on political opponents and whoever else this madman thinks is his 'enemy'. Had nothing to do with terra-ists.

5. The list is all in Cheney's Ipod
Whoops! I accidentally dropped it in the sea, 25 miles offshore.

Oh, well, stuff happens.
