CBS Evening News "A Christmas Story"
Just saw the story of the generous guy in Houston giving away all those bikes to kids.
Fantastic, but I was concerned when I didn't see helmets being used or shown.
Anyone know if helmets are the law for kids in Texas?
Regardless, I think that if no helmets are being given, with each bicycle, then that is terrible.

1. To the best of my knowledge
everyone in Texas must wear a helmet when riding a bicycle.

2. The kids were riding them when they were giving them out
no one had a helmet on.

3. There is no statewide bicycle helmet law
according to BicycleAustin.info:

"Proposed Statewide Helmet Law

In 2003, HB 2488 would have required cyclists under 15 statewide to wear helmets but the bill died in committee.

In Spring 1999, a similar bill applying to cyclists under 18 statewide to wear helmets came very close to passing (sailing through both a House and Senate committee with almost no opposition), but died at the last minute after a second senate committee didn't pass it. Below is some historical information about the 1999 bill."

Texas does have a law that municipalities cannot pass such a law without instituting a bicycle safety education program in the schools:

"Statewide Helmet Laws (Texas)
As part of the Matthew Brown Act (HB2203), municipalities may not enact helmet laws for kids (16 & under) unless they have also instituted bike safety education in schools, and unless they have made provisions to provide helmets to children of low-income families."

4. A very generous individual
It warms my heart that someone would be so generous as this man. As far as the helmets are concerned, I learned to ride a bike without a helmet as well as my kids and grandchildren. I realize that sometimes bad things can happen when not wearing a helmet but bad things can happen just walking to school.
