Courtney Love Charged - 2 Felony Drug Counts - Possessing Hydrocodone & OxyContin without a prescription!!

Passe rock stars: NOT OK to Possess OxyContin
Conservative radio hosts= OK to Possess OxyContin--he has a problem, after all.

Hypocrisy at its finest. And I don't even like Courtney Love!

2. From what I've read...
They have information that he purchased (not sure if taped phone calls are admissable in court in Florida) but he was not caught in posession of anything. It's going to be tricky to see if they can charge him or how.

... but those tapes were absolutely "probably cause" and they could have searched him and his house any time they wanted to, they apparently chose not to.

This is pure selective enforcement.

Without possession, he will not be charged. They should have set up a sting. If the Enquirer hadn't been in such a panic to publish the story, the police could have set Rush up and nailed his fat ass.

True, I am not a lawyer. Can you qualify your statement that this post is not correct? I'm just trying to find information on the subject. And it's not fair to tell someone they're wrong but not explain why.

15. You need not be caught in the act of possession to be charged
for criminal possession, unless there's some quirk in FL criminal law that sets it apart from the rest of the U.S. Generally, IIRC, the elements are possession and intent to possess. The former of the two elements can be established without showing that the defendant was caught by the police possessing the drugs. For example, the testimony of the maid could clearly establishes the element of possession.

Lighten up pal. I wasn't talking about the law. I said that unless they caught him red-handed with the drugs, the were not going to charge him. I didn't say they didn't have the right to charge him . . . just that they wouldn't. It was an opinion. I'm a CPA not a lawyer. But I wouldn't want to prosecute a case where my star witness was a drug dealer. Not that a case couldn't be made, but Rush's lawyers would tear her character apart. PLUS, it is crystal clear that she is out trying to make money on this story. I don't think they will prosecute based on her testimony and some inadmissable tapes.

That's why I'm pissed. Had she worked with the authorities longer, instead of running to the Enquirer, they could have set up a sting and nailed his ass.

21. He doesn't need to be in possession of the drugs...
He was buying illegal,plain and simple. The police have a sworn statement from the actual PERSON that supplied him,not from some third party source.

What your seeing here is the type of justice that $30 million per year gets you.

that he hasn't set foot in Florida since this story broke, maybe his lawyers have advised him it would not be a good idea to go home at this time?

As far as I'm concerned, he can stay away for the rest of his life. We already have enough slimballs down here with Jeb and his CANF buddies, that one less slimball in this state is a good thing.
