2. I know it's a jokey thread but...
for the record, by definition, frivolous suits are dismissed. If a judge agrees to hear the case, it is not frivolous. And if a jury finds the defendant guilty of whatever damage or negligence, it obviously doesn't consider them frivolous either.

The whole notion of "frivolous lawsuits" has been blown completely out of proportion by the media. Besides, repukes sue like crazy.

5. When have the Republicans ever been bothered by facts?
Edited on Mon May-03-04 08:37 PM by xray s
Your point are well taken. But, the bottom line is, people lap up their lies and deceptions like a kitten laps up a bowl of warm milk.

Lawyers have to realize that have to stop responding to their lies by writing pieces on the on the op-ed page and start getting the message out agressively in the popular media that they are not the problem. An out of control, private, corporate run insurance system is the problem.

3. he's got a real thing about "frivolous and junk" lawsuits
Or "junk and frivolous" (he seems to alternate). And he usually throws in a flippant referral to "docs" ("doctors" to the rest of us).

4. If only the healthcare
mess was that simple! Of course, simple answers put forth by a simpleton...or at least someone who appeals to simpletons.

6. Here's what horrifies me:
The AMA doesn't police their own very well. A doc can KILL a patient through negligence and chances are, he or she won't lose their license. If they do, it's as simple as moving to another state and getting a new one.

And, girls and boys, we CAN'T find out if our doctors have previously harmed patients. The info just isn't available to the plebes.

When we had a proposition in Texas to limit malpractice awards, the SO and I did some research, and it was eye-opening. There is a doctor in Houston who drove by his business partner's house and shot at him. He wanted to kill him. He didn't even get reprimanded by the AMA.

I used to work in insurance. The way it works for everyone but doctors is that if you cost the insurance company money, you pay higher premiums. Wouldn't that be nice? Docs who get sued repeatedly, and who are found negligent, get to pay higher premiums. Docs who are good folks and do the right thing for their patients get to pay lower premiums. Sounds easy.

When a doctor can replace the organ they removed by mistake, or give you another foot after amputating the wrong one, then we can talk Tort reform. Until then, let's take the burden of the damned patient!!!!!!!!!

Whew. I'm done. :P

14. Give us some decent doctors first.
The American healthcare system is a joke. The lawsuits are SYMPTOMS to what is a much greater problem.

Repukes love to cover up symptoms and not give a frack about the PROBLEM. And that's a problem too!
