A legal question
If anyone is a lawyer, this is something I'm curious about.


Lets say two friends (Let's call them Kevin and Jordan)and I are roommates, and we decide to buy a videotape, splitting the cost among the three of us. The tape costs $12, so we each give Kevin $4 and he goes down to the store to buy the tape with the cash.

Now, the question is: Who is the legal owner of the video tape?

Do each of us own 1/3 of the tape?
Does Kevin own the tape because he physically bought it with our money?
Does whoever happens to possess it at the time (of us three) own it?

1. you share it
think lottery tickets, where those who chip in get to share, even if they have to sue their former friends to get it.

for example, if the videotape should turn out to have the missing footage of shrub sucking on a donkey dick, the three of you would share the fortune.

Sorry to digress from the topic, it's just interesting that it's always someone fiddling with an animal that's got a hoo-hoo-dilly but never a cha-cha?!

i'm not a lawyer, but my understanding in this situation is that you all would own the tape ...

for a contract to be binding (even a verbal contract), you must have "offer, acceptance and consideration" ...the offer was made by all parties to share the tape and the acceptance was also by all parties ... the consideration to "seal the deal" was the $4 each person paid ...

while Kevin might have an easier time proving he's the owner because he actually made the purchase and could produce the receipt, all would share ownership of the tape if the facts as you presented them were acknowledged by all parties ...
