Deputy Honored By MADD Wrongly Jailed Dozens For DUI

TAMPA - Daniel Brock won high praise for jailing impaired motorists. Mothers Against Drunk Driving honored him. So did his bosses.

But one of Hillsborough County's most aggressive DUI deputies may have wrongly sent dozens of people to jail, the Sheriff's Office acknowledged Thursday.

The agency fired Brock on May 24.

In one year, Brock arrested 58 people whose blood-alcohol content was below 0.08, the level at which state law presumes a driver is impaired, an internal affairs audit showed.

"I don't prescribe to the theory that somehow you have to be 0.08 to be drunk or impaired, " Brock, 38, told investigators.

Repeatedly, investigators found Brock reported failures in field sobriety tests when his patrol car video camera documented the opposite. He wrote, for instance, that a driver on Oct. 25, 2005, lost balance while turning. The video of the encounter showed that wasn't the case. The driver blew a 0.01 in the breath test but was arrested anyway.

1. Though I'm not a fan of drinking and driving
I've been saying for a long time that the DUI laws are being abused by overzealous law enforcement and a cash hungry legal system, and this is proof. For every one cop like this they catch there are often many more doing the same thing.

Needless to say this would never have happened with Mike Hunt hovering around



This IS a different Mike Hunt-this one...swear to GOD.. is a "Resource Officer" (school cop) at a MIDDLE SCHOOL!!

4. So this guy enforces his own theory on what the law is and should be
I hope they arrest him for abuse of power and kidnapping so he get to be "processed" in a jailhouse as well. Plus maybe someone should call MADD and have his "honors" recinded.

They fight drinking and driving and underage drinking. They do not care if you drink or not as long as you are of legal age and don't drive. Should you run into someone representing MADD that talks prohibition you should complain to the local or national MADD chapter.

The biggest part of MADD is Victim Services and they are the biggest provider of victim services in the country.



Edited to add- They should do more than fire that cop. He should be charge with filing false reports, false arrest or something.

6. He arrested someone who blew 0.01?
A spray of Binaca would probably do that.

There will probably be a lot of lawsuits against that police dept. now.
