Need advice after drug test
I took a pre-employment drug test and they allowed me to start my new job pending the results.
I am on a timed-released heavy duty pain killer through pain mgmnt and this prescription is to be taken every day by agreement w/the dr. This regimen allowed me to actually take a desk job which was preferable to sitting at home. The job I am in is the only one out there which will work for me. I am not going into the reasons why.

Anyway, I was called into the office and told my test results were taking a long time and my bosses asked if I was on any prescription drugs. On the spot...I told them yes. They asked if I had told the testing company and I had not since they said they did not need to know and I had even asked if they wanted to see my prescriptions and the answer to that was negative as well. The big boss asked what the drug was, what it was for, how many mg and how often. On the spot, I told them. When I arrived home, I had a msg from the drug testing company (almost a week later) so I called and was given instructions to have the pharmacy fax a copy of my prescription. The next day I was able to verify that the dr at the drug lab had sent off a result of negative to my job. I am assuming this means that there was nothing in my system that was not prescribed or illegal.

The problem is that nobody at work said anything to me today nor was I finally given my badge to get in the door.
I did notice what seemed to be a lot of closed door meetings going on.

I think the drug testing company dropped the ball, but I could be wrong.
What to do if they let me go at this point?

1. I have to get to sleep so I can get up early for work
Hopefully there will be at least one response by morning.

It is difficult right now feeling like there is another shoe about to drop.
I am exhausted!

Thanks for the assistance! :hi:

It depends on the reason that they give to let you go.

The big boss broke the law by asking you the details of the drugs you take, right down to the mg. The people who employ you do not have a need to know that...only the drug testing company does.

It appears that the drug company got an initial positive on your test due to your prescription drug. They then asked you for your script, the positive was explained, and they cleared you.

Before this, the drug company called your boss (which also does not sound copacetic), and explained to them that you were a positive. This is why the big boss was asking you the details of your prescription.

What I would do is the following.

While this is all fresh in your mind, sit down and document what happened down to the last detail. If they do indeed let you go, listen very carefully to the reason they give you. If they do not give you a reason, ask them directly if it has to do with the drug test.

Then go home and document that conversation.

Depending on what happens, you may have a wrongful dismissal. A lot depends on what it says in your employee handbook concerning your probationary period, etc. However, I am concerned about an inherent bias that your boss may now have toward you since he knows your medical details...details that he has no right to know.

6. If I were you I would not have volunteered the specifics.
They shouldn't discriminate against you for being on prescription medication- its illegal. They aren't allowed to test you until after you have the job.

Try not to worry about it till something happens. If they let you go you should ask why- you haven't really been around long enough for them to evaluate your work.

The testing company really should ask you to write down your prescriptions on the form that they use. That way there are no surprises or false positives. I do contract work and I go through this 2-3 times a year. Sometimes they ask if you are on any meds ahead of time. Sometimes they do not. I have never not passed a test, but it makes me uncomfortable enough that I sometimes stop taking prescribed drugs for a few days ahead of the test. I basically don't trust these things.

12. "They aren't allowed to test you until after you have the job."
Is that true? I've seen all kinds of job listings that make hiring contingent upon a successful drug test. Is there some loophole I'm missing?

8. An update....
First of all, I want to thank everyone who gave me advice.
I have not heard a peep from management but have noticed plenty of closed door meetings going on. Even in my short time employed, it has been strange.

I believe they are looking over my work to see if they can find any excuse to get rid of me, but there will not be any. I have excelled in my tasks thus far. I have been timely with when I arrive to work, with breaks, lunches, and when I clock out for the day.

Even though I have felt a great weight on my shoulders WAITING to hear what they will do, I have demonstrated an eagerness to do whatever I am asked to do, and generally behaved like there is nothing out of the ordinary going on. To all appearances, I am enjoying my job...the stress I am feeling is hidden and believe me, the stress is enormous! I have not mentioned what is going on to any of my co-workers.

Hopefully everything will be fine but I have the knowledge of what to do if things go south.

Oh, and in reading the ADA, it appears they CAN ask what prescriptions you are taking.

Take Care!
