If Davis resigns, is the recall moot?

If Davis resigns, is the recall moot?
I think it is, on the grounds that you can't recall someone who is not in office. According to the CA constitution, if the governor resigns, the Lt. Governor becomes governor until the next real election. I believe that, if the recall would be undercut by Davis' resignation, then Davis will be pressured to resign, and will do so in the first week of October.

Cruz will be governor until the recall but the recall ballot with the list of candidates will still go forward and one of those people will be chosen to fill out Davis' term.

3. Onlyl under the CA Constitution. Kevin Shelly (the Sec of State
and Bush's best friend) seems to feel the Constitution is moot and the CA Supreme Court (stacked with Republicans as a result of too many Republican administrations) is refusing to hear Constitutional challenges. Kevin Shelley, who is trying to get the legisture to change the law so Bush can be on the ballot next year, has decided that the CA Constituion doesn't exist and nothing will halt or slow down the recall. What we need is not a new governor but a new secretary of state.
