The Cornhusker State’s preemption clean-up bill, LB 817, was signed into law yesterday by Governor Dave Heineman (R). This legislation will prohibit cities, counties and any other municipalities from passing any sort of ordinance relating to registration of handguns for concealed carry permit holders.
Approval of this legislation was followed by Attorney General John Bruning’s (R) recent opinion stating that the City of Omaha was violating state laws. During the 2009 legislative session, the legislature passed LB 430, which gave the state the sole authority to regulate statewide concealed carry laws. However, Omaha has refused to acknowledge that this would also apply to the draconian handgun registration requirement and have continued to enforce the ordinance in violation of state law.
