BB guns would get bright colors under CA bill

SACRAMENTO, CA (AP) -- Manufacturers would have to make BB guns in bright colors so they could more easily be distinguished from real guns, under a bill approved by the state Senate.

Sen. Kevin de Leon, D-Los Angeles, introduced the bill after numerous tragedies in which police mistakenly shot people carrying BB guns.

His bill, SB 798, is patterned on a law requiring that imitation firearms be made in bright colors to avoid the same problem.

...because they already color toy guns in bright colors. Doing the same to BB guns, which can cause serious injury, and making it impossible for people to distinguish between the two, is idiotic!! In fact, the two guns they show in the picture of the article can also fire pellets, which can be deadly if you're hit in the wrong spot! WHY would you want people to confuse something like that with a toy?

Also, I've always wondered if there's been any studies done since the law as made to make toy guns in bright colors on criminals painting their real guns in bright colors in order to fool law enforcement. I'll search around and see if I can find anything, but if somebody else here has info, feel free to toss it on here.

EDIT: So I didn't find any studies, but I did come across several LEO's saying that they treated any gun pointed at them, be they brightly colored or no, as a real gun, which would make any painting requirements seem a bit useless I would think. I know we have some current and former LEO's here and I'd like to hear them weight in on this as well if they don't mind.

Bloomberg/NYC wanted to pass an ordinance that would have banned the sale of "gun coloration or paint kits" (I guess the thought of someone using any other commercial spray paint permeated their thick skulls)...

As to the creativity of certain criminal elements, here's one example that even I have to give credit where credit is due...


Water Soaker Converted to Shotgun

Miami Gardens, FL (HC)

The below intelligence came from what was originally an officer safety bulletin for the Hillsborough County Sheriffs Office (training Bulletin # TB-09-003. Dated Feb 23rd, 2009.)

On Feb 22nd, 2009 a patrol Deputy came across the above child’s super soaker. However what was found inside the power soaker was a Mossberg 12-gauge shotgun. Both the shotgun and the water soaker were fully functional.

This is more evidence that gun restrictions will always be circumvented by criminals.

15. Sadly criminals arent stupid
Ive seen highlighters turned into guns, and a small bolt with a spring loaded nut fire bullets. IMO, if anything was pointed at me I would pay close attention. It really depends on the situation but complacency is deadly.

2. Exactly. The police would need no help if there were no limitations on carrying weapons.
Life would be peaceful and beautiful and everyone would get along. On the rare occasions when someone got out of line, good citizens would take care of business.

Police should be strictly in the business of enforcing parking laws (which is a denial of civil rights, btw), getting cats out of trees (another denial of civil rights), and directing traffic (another violation of civil rights).

16. I wonder if the creator/holder of the "Super Soaker"...
was charged and prosecuted by the feds for an NFA violation?

I'm guessing it could easily be defined as an AOW (Any Other Weapon).

14. My wife has wanted a pink gun for some time now.
I've even thought of getting her XD9 duracoated, but not something that is high on the priority list for either of us right now, financially.

It all started when the mayor of New York made it illegal to paint a firearm to make it look like a toy. It seems as though some unsavory types were attempting to disguise weapons by spray painting them to look like a theater prop or toy. It seemed like a reasonable measure. Unfortunately, gun advocates disagreed.

Gun manufacturers, angered by the mayor's new law, have begun to market an in-your-face response: They've begun making real guns that look like toys straight off the assembly line. I kid you not. (And the NRA wonders why safety advocates are so critical of their industry.) What's next guys, child friendly hand grips? These new firearms, painted bright colors and labeled with cheery paint coatings such as "watermelon red" have begun to hit the market. Pistols in hot-rod red, candy apple green, shiny purple, bright yellow, hot pink, and all sorts of other kid-inviting colors are being bought and sold as we speak. Some even have a little cartoon decal on them, meant to mock the mayor but all too similar to something you might find on a toy car or skateboard design. Naturally, this is more than a little concerning to us.


There is a large group of Americans that just LOVE their guns and while I'm not one of them it appears there is nothing that can be done about it.

...even when it comes to their firearms. Everybody has a favorite color, even gun owners. The people that run the keepyourchildsafe.org website are in reality doing a massive disservice for their readers, because instead of telling parents to do what is best in a household with guns, and that's teach their children about firearms and firearms safety from a young age, they are simply instilling fear in parents, and waiting for some sort of "I told you so" moment like a bunch of ghouls.

The shade of orange (Color No. 12199) required by United States law (U.S. Code of Federal Regulations, Title 15 Commerce and Foreign Trade, Section 1150.3) to be on the tips of barrels of replica guns such as airsoft guns, and cap or toy guns comes in spray cans.



Crooks tried that trick likely before the ink was dry on the Federal law in 1989.

You are right...

We disagree as to the reason. I think it's because the crooks, being crooks don't care about the law. If he think painting a gun will give him an advantage in a murder, you think the killer will say, "No, I better not, that's against the law."

Why do you think so many wanted crooks get caught during routine traffic stops. If breaking laws against robbing people or burning down buildings doesn't bother their conscience, do you think rolling through a stop sign will?

You blame the NRA's fault because they are rubbing your nose in your own stupidity and you don't like it.

You're hoisted by your own petard.

I grew up in a place where every kid on their twelfth birthday go a 22 rifle for a birthday present.

We moved to New Jersey when I was 11. If I didn't live in a state with such fucked up gun laws I would own guns, hunt, target shoot, etc., maybe even join the NRA if they weren't just as fucked up in their own way as the state I live in.

The NRA really sucks politically if you haven't noticed while staring myopically through your gun sight.

First, way back in 1989 a Federal law is passed that all toy guns have muzzles painted "safety orange." The law is passed in the wake of a highly publicized shooting in where an LA policeman tragically shoots a small boy with a realistic toy gun during a chase with an armed suspect.

The "unforeseen" outcome:

So we get another law limiting the criminal misuse of spray paint.
