Barghouti convicted in deaths of five people
The Tel Aviv District Court convicted former West Bank Tanzim commander Marwan Barghouti in the deaths of five people on Thursday.

Barghouti was convicted of three terror attacks in which the five were murdered, as well as in another charge of attempted murder, membership in a terror organization and conspiring to commit a crime.

However, the court acquitted him of 33 other murders with which he was charged, noting that there was no evidence that he was a full partner to those incidents.

The prosecution on Thursday will ask the court to sentence Barghouti to five life-terms for his conviction.

10. Guilty by association
You convict the court by association in our own mind. Not very convincing to me.

It should have said "your" mind not "our" mind. My finger missed the y. No collective. And none of your beeswax if there were.

And no, you didn't say "guilt" but it was certainly implied by the setting up of a parellel with Nelson Mandela trials.

6. Innocent people can get convicted to crimes
Edited on Sun Jun-06-04 09:35 AM by Classical_Liberal
and this trial is very controversial, because many people think he is innocent. He is considered the most probable and competant alternative to Arafat. Many think it an attempt to smear him so the Palestinians will be led by a quisling weakling instead. This isn't actually good for the state of Israel though it is good for Messianic Holy War factions of Israel. Anyway, it isn't like he can get a fair trail in a country that is not his own. Israeli courts have a rather gross record when it comes to Palestinians. Remember the 13 yr old Palestinian that was rifle butted to death by a settler? The settler got just 6 months and than didn't have to serve any of it becaue the sentence was commuted.

7. The country where the crimes were committed

is where the defendant should be tried.
He has even admitted to some of the murders.

The court ruled that Barghouti was directly responsible for a January 2002 terror attack on a gas station in Givat Zeev in which Israeli Yoela Chen was murdered. The attack, the judges said, was carried out at his direct order in revenge for the assassination of Raed Carmi. Barghouti had admitted his responsibility for this attack.

The attack in which a Greek monk was murdered in Ma'aleh Adumim on June of 2001 was also carried out at the instruction of Barghouti, the judges said.

The former Tanzim leader, the court ruled, also approved the March 2002 attack at Tel Aviv's Seafood Market restaurant in which three people were murdered, as well as a car bomb attack in Jerusalem.

The judges said Barghouti's orders for terror attacks were sometimes "based on instructions" from Palestinian Authority Chairman Yasser Arafat.

That name sounds familiar. Yasser Arafat. The big snake.

13. Not according to his defenders
. according to his defenders the charges were trumped up and the confession were extracted under torcher. If you torcher me I will confess to having sex with Satan. Wouldn't make it true though.

15. The charge of torture
Because there was no confession, how can you say it was extracted under torture? The admitted guilt was actually his bragging on another occasion, to the best of my knowledge. He was an outspoken political figure who promoted violence. Although he generally limited his approval for violent attacks to areas in the territories and outside the Green Line, some of the attacks did take place in Israel proper, and with proven links to Barghouti. Thirty-three of the charges were dismissed because of lack of conclusive evidence.

8. has constantly denied the charges
Just minutes before his sentence was read out Barghouthi, who has constantly denied the charges, said he was indifferent to his fate at the hands of the court.

"This occupation is the ugliest colonial occupation that humanity has known, but this occupation is dying and they had better start preparing for its funeral," he told the court in Arabic.

"I don't care whether I am sentenced to one life sentence - or 10 or 50 - my day of liberty is the day the occupation ends."

11. Even assuming he committed the crimes
Which is doubtful, that'd make Mr Barghouti less of a terrorist than Sharon, and less of a killer of Jews than Begin.

I'm sure that'll be pointed out over and over... not.

16. A pathetic show trial
Nasru'llah should've pushed for Barghouti too when he had Jabba bent over his knee.

May his release somehow be swift.
