It seems clear to me that prior to the Patriot Act, the President had the power to stop the 9/11 attack and DID NOT USE THAT POWER.
In response to the 9/11 attack the President chose to ask Congress for more powers and Congress passed the Patriot Act in 2001 and then afforded the President even more powers in a 2003 upgrade to the Patriot Act.
