does anybody know if the FISA statute was judged to be superceded by the constitution in the judiciary committee hearings like specter is saying?

1. No, that's just the opinion of "reputable sources" acc. to Arlen...
IF, he says, IF the prez has inherent authority in the Constitution, then the Constitution supersedes a statute.

do not have unlimited executive Authority. The constitutional authority is really ours as in

4th Amendment
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated; and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized.

I think what you're hearing from Specter is double talk. What Shrub did has nothing to do with Constitutional authority, but with utter disreguard of the law!

He's wrong in pretending that the Constitution has no 4th Amendment.

Such a concept would have to come from the Supreme Court, I would expect. The Senate or House Judiciary Committees don't get to interpret law like that.

Politically and procedurally, however, they could decide to ignore the issue on whatever basis they want.
