This could be a done deal if Congress would just grant Immunity:

When you get right down to it, Michael Mukasey has refused to answer the question of whether waterboarding is torture for three reasons, which he provided in his letter to Senate Democrats earlier this week. Two of those are readily disputable (not wanting to tip off "our enemies," for example), but the key to his rationale appears to be his expressed fear that the attorney general's public acknowledgment that waterboarding is torture would place interrogators in "personal legal jeopardy."
Not to mention personal legal jeopardy for the President of the United States.—Caro

2. With that statement he is admitting that US agents, under
George Bush's orders, are water-boarding prisoners - therefore the US does torture prisoners.

But there is an even larger issue here that everyone is ignoring: the abuse of prisoners in US custody. By focusing on what technique is and is not torture, everyone, including the President and our elected Democrats, have admitted that we abuse prisoners in our custody. We methodically, systematically mistreat prisoners, we abuse detainees and subject them to inhumane treatment - everyone has admitted this. And everyone is okay with this - as long as it doesn't ooze over into "torture". This is the most sickening development yet. Our government - Democrats and Republicans, alike - support the abuse and misuse of prisoners in our custody, and give it not a second thought. Proud to be an American? Not lately...
