Don't we have another Pentagon Papers situation? Would The New York Times Co v. United States Supreme Court decision of 1971 forbid prior restraint by the Obama Administration on the publication of the photos?

1. If The Past Is Prologue
The answer would be no way it'll happen. This is no longer the Times of the Pentagon Papers just like Woodward is no longer Woodward.

2. Pretty much my conclusion since the Times was opposed to the Nixon Admin. and supports Obama.
However, if it came out that the Times HAD the photos but wouldn't publish them (which is their right to do)then it would come under a huge amount of criticism. The paper, already in trouble financially, would have a serious problem of credibility, perhaps fatal to it.

3. Nothing. I'm sure Obama knows they will come out at some point
But in my opinion he needed to sort of show the military commanders that begged him not to release them that he could stand up for them. And thats what he's doing, even if he has to take his lumps.

4. The Times would lose any hope of a Fed bailout
They would close up shop.

6. That's not what happened when they published the Pentagon Papers.
And that was during the Vietnam War and with the Nixon Administration.

They have no business getting a government bailout for exactly the reason that is implicit in you response.

5. Internet distribution of photos seems much more likely now

Fascinating question, though.
