11. no, they really couldn't have.
the only possible defector was/is Nelson of NE and he won't filibuster. He likely won't even vote against Sotomayor.

in the first place. Yeah some of them going make a stink, but most aren't going want to deal with the bad press from trying to torpedo her. They're gonna keep their powder dry on this one.

8. It will give the Republicans a talking point in their campaigns back home
The Republicans will talk big about President Obama's appointment of Sotomayor, then make the comment back home "There was nothing I could do, those mean ol' Democrats stifled us. Vote for me!"

She'll be confirmed by a large margin. There is nothing new under the sun. She's not new, and she's not avante garde. She's a safe pick whose tenure on the bench began with a nomination by GHWB. The rethugs won't vote against that.

Tell me President Obama didn't know that going in.

13. The votes weren't there
Collins, Snowe, and Lugar probably weren't going to go along, and since the Democrats (including Sanders and Lieberman) were likely to stick together, a filibuster isn't a realistic threat.
