Supreme Court rejects part of Texas redistricting

I haven't had a chance to read the ruling but we'll go with the traditional media's report for now.

The Supreme Court on Wednesday threw out part
of a Texas congressional map engineered by former House Majority Leader

voting rights.

The Supreme Court on Wednesday threw out part of a Texas congressional map engineered by former House Majority Leader Tom DeLay, saying some of the new boundaries failed to protect minority voting rights.

The fractured decision was a small victory for Democratic and minority groups who accused Republicans of an unconstitutional power grab in drawing boundaries that booted four Democratic incumbents out ofoffice.

Justice Anthony M. Kennedy, writing for the majority, said Hispanics do not have a chance to elect a candidate of their choosing under the plan.

Republicans picked up six Texas congressional seats two years ago, and the court’s ruling does not seriously threaten those gains. Lawmakers, however, will have to adjust boundary lines to address the court’s concerns.

At issue was the shifting of 100,000 Hispanics out of a district represented by a Republican incumbent and into a new, oddly shaped district. Justices had been told that was an unconstitutional racial gerrymander under the Voting Rights Act, which protects minority voting rights.

According the the SCOTUS blog, Congressional District 23, is invalid.CD 23 is the 'now held by Henry Bonilla (R). What to do... what to do... More to follow....

1. Taking Laredo out of CD 23 was done at the very last minute
before the final vote. It was done because Henry Cuellar came within 3,000 votes of beating Bonilla in '02. There was no discussion, it was just presented as is and voted on. Laredo was moved into what was then Ciro Rodriguez' district and Cuellar won in '04 and the primary in '06.

2. We are so screwed
The court also ruled that the state legislature can redistrict as often as it wants, not just once every 10 years. That means, put simply, that every time there's a power shift down in Austin, we have to go through the same damn thing over and over again.

Both major parties will have to hire full-time cartographers to make sense of all the recent district boundary changes. Whoopee.

3. That was a "be careful what you ask for" thing
because Northeastern states and California can redistrict next year and guarantee the Democrats take Congress in '08. There would be nothing the GOP could do about it. The GOP got greedy and weren't careful about what they ask for.

8. SCOTUS ruling = partisan bickering x 50
This ruling adds fuel to the political polarization of our legislatures. Forget about bipartisanship (if we can ever return to those days). Their eyes will always be on the congressional maps, pens at the ready, diverting time from more pressing matters of the people. We will long for the days when this was a once-a-decade fight.:mad:

These fights every 10 years are bad enough..This is what took precedence over hurricane relief. This BS was what took precedence over school finance. Disenfranchising minorities is what these people do!
Why would any minority EVER vote for them! I'm amazed Bell is polling so poorly among Hispanics. Have we so short a memory?!!

5. You know
when I'm casually talking about the governors race, I always remind people (esp moderate republicans) of two things: 1. The redistricting instead of working on school finance and 2. people running out of gas while evacuating from Rita. Those two things work really well to get people on your side.
