OHIO Supreme Court ?
Once this enters the courts, I think it's headed right for the Ohio Supreme Court. Is anyone familiar with them? Are there any democrats on there? could be a key issue.

Has the Governor of Ohio said anything about all this yet?

And how sick is Renquist?

I hear if he can't vote and there's a tie in the US Supreme court, it goes back to the lower court's ruling which would be the Ohio Supreme Court.

1. Rehnquist
Bush has the authority to appoint a provisional replacement if anyone on the court is incapacitated. At least I am pretty sure.

2. what if one person on the S.C. regrets what they did in 2000
it only takes one person on the SC to change his/her mind over the last 4 years about bush

I think we have to face the reality that we could be headed back to the supreme court again.

3. The contest of election to be filed by Cliff Arnebeck in Ohio ---
goes to the Ohio Supreme Court directly -- can go to one justice, or the whole bunch. I believe I read that the court there is predominantly R.

6. One of the Republicans on the Ohio Supream Court contested an election
Pfeifer, a Republican now on the Supreme Court, argued that irregularities such as discrepancies between the number of ballots and the number of signatures in poll books could have cost him the election.

The six members of the court who ruled on the case disagreed and Fisher won.

10. Pfeifer is a RINO and ran unopposed in this past election

He is a Republican, but he puts the people ahead of party and special interests. The man is a bedrock of integrity. He is a true rural conservative who stands for the common man.

In the infamous DeRolph case (1997) about the constitutionality of the public school funding, Pfeifer sided with the Democrats in stating that the property tax system is unfair and inequitable and a new system of funding should replace it.

The Republicans tried to oust him in their primary in 1998 as a result of the DeRolph ruling, but were unsuccessful. Eventually, the Republicans got enough right wing justices on the court to overturn the ruling, thus the schools continue to suffer.

The Democrats know not to oppose Pfeifer because he's pretty much on our side. He was only the Republican I voted for in the election and he earned it.

He could very well contest the election if he feels the evidence is convincing.

14. I object to the term RINO
at least in this context. He's more what I'd consider a true Republican (as opposed to the Neo-cons). How would you like to be called an "American In Name Only" because you didn't agree with everything "your president" says?

Remember, Abe Lincoln was a Republican. The values he stood for are still alive and well in the Republican party--but temporarily eclipsed by this infestation of "Neo-con" nut jobs.

Instead, I'd call Bush the RINO. He's certainly no conservative (Look at his spending! He want to change the constitution for no good reason?! He'll just ignore the constitution when it gets in his way!?!?). Bah!

The numbers will be 1 Democrats to 6 Republicans starting
in January, when the new Justices are seated, right now it's
still 2-5. Ohio elects its Supreme court Justices.
One (Democrat) justice had to retire due to age, leaving an
open seat which was won by a Republican. There were four total
elections for the court, no Republican was unseated.

Hence the switch. But the trick is that 2 of the 4 Republicans
seem to be somewhat moderate, crossing party lines to vote with
the Democrats on some cases, and making for some 3-4 split
decisions which Ohio Repubs have been unhappy about. Those
swing Justices would still be on the new court, making it, I
suppose, something like 4-3 for the Republicans.

It will soon be 6-1 Republican since Francis Sweeney is retiring and the Republican candidates swept the election. The only Democrat that will be left is Alice Robie Resnick, whom the Republicans viciously tried to defeat in 2000, but fell short. Like I mentioned in another post, there is Paul Pfeifer, a liberal to moderate Republican who often functions like a Democrat.

12. Arnebeck also involved in litigation about the OH Supreme Court
In the congressional hearings, Arnebeck introduces himself and states that before the 2004 election he was involved in litigation concerning the election of some justices on the OH supreme court.

I wonder if voter fraud was involved in those elections

if so it shows how much Rove has planned for a recount and litigation in OH.
