The Palm Springs Police Department is accused of discriminating while enforcing city laws.

These allegations stem from a police operation that led to the arrest of 24 men in Warm Sands last summer.

Officials say the men charged with indecent exposure were engaged in sexual conduct within 15 to 20 feet of a roadway in a parking lot.

Dave Erskine, a frequent visitor to Warm Sands, said he's seen people have sex behind bushes in the neighborhood. What he didn't know was the consequences of such behavior.>>> more

If convicted, the 24 men accused of indecent exposure would be required to register as sex offenders for the rest of their lives

Appointed DA Rod Pacheco is accused of being behind this , cutting a secret deal to only accept felony busts carrying lifetime sex offender penalties. ATTN Riverside county voters

1. I agree - this uneven treatment needs to stop
"Prostitutes are out there having sex in public, alleys, cars..if they get arrested, it's a slap on the hand; they don't have to be registered as sex offenders," Van Etten said. "Why are these men being singled out? They're being singled out because they're gay."


For those unfamiliar Warm Sands in an area consisting of about 10 "clothing optional" resorts. Most the sexual activity goes on inside the resorts, however, after the bars close it become a pick up place, and just like in the heterosexual world people do have sex in public on occasion - those involved in this consensual adult behavior should not be classified as a sex offender.
