Judge Says Molestation Defendant Is ‘Gayer than a Sweet Smelling Jock Strap’

A Wisconsin judge on Monday said he didn't believe a molestation defendant who insisted he was heterosexual, making his point with references to a jock strap and a prom dress.

Judge Philip Kirk of Waupaca commented before sentencing former New London school bus driver Delton Gorges to seven years in prison, according to Fox11WLUK-TV and Fox6Now.com. “I think you were born gayer than a sweet smelling jock strap,” Kirk said.

Gorges, who drove a school bus for 33 years, pleaded no contest to four counts of fourth-degree sexual assault, the Appleton Post-Crescent reports. Fox11WLUK-TV posted a video of the judge’s remarks.

"I think that if anyone believes that in the last 10 years or 15 years all of a sudden you developed an interest in homosexuality and young boys, then I must have looked ravishing in my prom dress this year,” Kirk said.

Kirk said he believes the 71-year-old defendant was the victim of a homophobic society in the 1940s and 1950s. "No one knew there was a closet to come out of in those days,” he said. “You know you had to be very careful, because you could have found your penis floating in the Wolf as walleye bait. It was a terrible life to have to live."

Critics told Fox11 they were concerned about the judge’s comments linking homosexuality with pedophilia. "Sometimes people don't say the right thing, but they potentially mean well, “said Andrew DeBaker, co-chair of the gay rights group New Pride. “The thing that concerns me is the linking homosexuality, linking being gay with, in this case, child molestation.”

While this is (and should be) a crime, this isn't pedophilia. A man who assaulted a 15 year old girl wouldn't be a pedophile either. That term refers to people who have sex with pre-adolescents.

But it's not pedophilia or child molestation.

Ephebophilia (as others) is often lumped with pedophilia. It's not the first time a technical and specific word has become shorthand for a whole category (sexual interest in those below the age of consent).

does this statement have to with pedophilia, or sexual assault ?
The judge insinuates that hompophobia in the 1940s and 50s makes life "terrible" for gays and turns them into pedophiles, rapists, or sexual assaulters?

Is someone who has sex with a 17 year old a pedophile, simply because the age-of-consent in Wisconsin is 18? No, and neither is s/he if s/he has sex with a 15 year old, even though most states have a 16 year old age-of-consent. Pedophilia refers to an attraction to pre-pubescents.

I'm not a mind-reader, but I think the judge was trying to say that men in his age group often had a great deal of self-hatred involved with being gay, after growing up in an era when the whole world seemingly despised them -- and gay sexual encounters were often furtive and anonymous. Self-hatred doesn't tend to lead to healthy sexual relationships with other adults. The judge seems to think it might have led to this man approaching teens who seemed less likely to resist him.
