San Jose Ordered To End Benefits For Married Gays

A judge has ordered the city of San Jose to stop offering benefits to the same-sex partners of municipal workers who were married in areas where those unions are legal.

In March 2004, San Jose became the first city in California to recognize same-sex marriages performed in San Francisco and outside the state, including those performed in Canada and Europe. (story)

The motion which passed on an 8 - 1 vote was drafted by San Jose Mayor Ron Gonzales and openly gay council member Ken Yeager.

When the California Supreme Court voided the same-marriages performed in San Francisco, the law continued to apply to those couples who married in Canada or Europe.

The Christian conservative Arizona-based Alliance Defense Fund filed suit on behalf of the Values Advocacy Council of San Jose and the Proposition 22 Legal Defense Fund claiming the benefits violate Proposition 22 which defines marriage as between a man and a woman.

The ADF is involved in fighting same-sex marriage across the country and the Proposition 22 Legal Defense Fund is one of two groups currently collecting signatures for a constitutional amendment banning same-sex marriage in California.

In a Monday ruling Superior Court Judge Mary Jo Levinger said that the city regulation "is contrary to California law and is therefore pre-empted. Furthermore, only marriages between a man and a woman may be recognized by the City of San Jose.''

4. It's interesting how. . .
. . . the idea of fags and dykes getting health care benefits and survivor access to pensions enrages the right wing so vehemently.
