NYS Appeals Court
Anyone know when they could be ruling on gay marriage in NYS?

3. Even though I'm moving to Jersey within a month I wish for the same.
Funny, though, that New Jersey is way more advanced with gay rights than New York. Especially for all the flack that people love to throw at Jersey.

5. There is also a NJ case which many experts think will be won
by our side. It is supposed to be handed down anyday now.

I grew up near New Jersey. My earliest trips to the "country" were there. New Jersey is way cool

7. Could somebody provide the backstory here?
I haven't been following this case. What are the details? If it's won, is gay marriage suddenly legal in NY?

8. I think so
it went to the Appeals Court (NY Supreme Court) to interpret whether or not the state constitution means marriage as only a man and a woman orwhether it should include all unions since it is not specific.

9. I believe so, as well.
The trial level court in Manhattan held that it was unconstitutional under the state constitution to deny us the right to marry. Fucking asshole Bloomberg appealed that ruling and the Appellate Division reversed it. That case and one or two more then went to the Court of Appeals for a final decision on the state constitutional issue.

Everyone was hoping for a positive decision on or before Gay Pride Day. That didn't happen. Now I am worried that it is a negative decision and they withheld it so as not to rain on our parade last weekend. I so hope I'm wrong, but one of the judges who was expected to rule out way recused himself for the stupid reason that his daughter advocates for gay marriage in other states. If there is a tie, the lower court ruling stands.

10.  But Scalia is allowed to rule on Bush V. Gore even though....

...his son is an *official* with Bush-Cheney campaign organization?

Any legal minds out there that can explain this?

11. It is completely up to a judge's personal judgment as to whether...
to recuse him or herself from any particular case.
