Sergeant to be arraigned in 2004 Iraq killing

OCEANSIDE, Calif. — Sgt. Jermaine A. Nelson will be arraigned at Camp Pendleton, Calif., on Thursday morning in connection with the 2004 death of a detainee in Iraq.

The Marine Corps has charged Nelson with unpremeditated murder and dereliction of duty for what prosecutors are contending was the “unlawful killing of an unknown unarmed detained person” on Nov. 9, 2004, in a house in Fallujah.

Nelson and his platoon with 3rd Battalion, 1st Marines, were conducting house-clearing missions and other operations to root out enemy insurgent fighters from the city.

The identity of the victim remains unknown — a fact that likely will arise during the case.

Nelson and two other members of his platoon at the time face charges in connection with the fatal shootings of several unidentified men who they had encountered in that Fallujah house.
