so why did the messes happen anyway? Did he fail to follow through due a lack of action or a lack of authority? If he lacked authority, who overuled him... when... and why? And were they deliberately acting against him or merely being inactive against him?

on edit: I must admit, those clips raised my opinion of him a fair bit. At the very least, he's capable of retaining summary information given to him by capable underlings. Whether he was merely spouting it without comprehending it was not 100% clear from what I saw.

I've had a crummy day and that was so good, I actually laughed out loud and rewound the tape to watch it again. Everything, from the way Keith says Dan's name, to Dan's picture being three times the size of Keith's to the caption "Dan Patrick & Some Guy" to the "No-Reilly" to the kicker was just :rofl:

And you know O'Reilly's head is exploding over this, which makes it even funnier. :evilgrin:

Keith is right...ESPN and Faux Sports knew better than to keep him on the air after he decided to go/they decided to dump him. They didn't keep him on air so he could rip them up one side and down the other and they could then sue him.

I agree she could have been more tactful and polite but

1) it's not inappropriate to conduct business over the internet
2) legally she is ABSOLUTELY right that they had no contract and neither had any obligations to the other; even if they had a verbal agreement, either could have backed out; it's called "employment at will"; that a lawyer would not know this suggests he is unprofessional AND not very knowledgeable--I suspect he DID know that and is trying to manipulate her and us, and it's not working
3) he insulted her by BEFORE any insults from her were reported--maybe they left her early ones out but in the report he struck first and then was indignant when she responded in kind
4) she's ABSOLUTELY right that he had no business threatening her, especially when she had done nothing wrong other than to make him mad by objecting to the low pay (according to the report)
5) there is NO excuse for his sharing the email exchange with others. Very unprofessional. She's lucky she didn't accept the offer.

Baby lawyers should not go around being rude, tactless, & pissing off more experienced & established lawyers. Contrary to her belief, she does NOT know everything about the law just because she graduated from law school & got her bar card. What she said about the salary being too low to support her lifestyle was incredibly immature & unprofessional. It really shows how inexperienced she really is. The fact that she's had to strike out on her own speaks volumes as to how she's perceived by the legal community in that area. NO ONE HIRED HER. (oh how the might have fallen--solos don't make shit their first few years, so she's going to have to make some adjustments to her grandiose lifestyle, especially since it's being funded by daddy.)

A verbal agreement CAN be a binding contract if one party has done partial, if not substantial, performance. This attorney can prove that by what he did (ordering business cards & letterhead, getting a computer set up for her). What damages he'll get (if he wants to pursue it) is anyone's guess.

It may come as a big surprise to the layman, but many lawyers still adhere to "my word is my bond." If opposing counsel knows they can't trust you, your practice will be that much more difficult because they will slap you with every kind of discovery & motion just wear you down & run up your bill.

Of course, I don't know anything about this subject.

was completely ridiculous but I have a lot of difficulty believing that he had in fact already ordered business cards, set up a computer, etc., unless they had agreed on a firm start date. I'd love to have been a fly on the wall for some of their communications prior to the email exchanges. I'm thinking that either she verbally agreed to take the job and subsequently decided she should have asked for a higher salary and the, "I said I was interested, I didn't give you an absolute yes" business is a lie or his "but I've already done all these things in preparation for your arrival" is a lie. I doubt she'd be such a valuable catch that he'd feel an inclination to lie about business cards just to pressure her into accepting the job, so I'm guessing that baby lawyer's on the wrong side of this one.

early conversations. Having gone through my share of job interviews though, I left the interview knowing I had the job or didn't. An offer was either made, or it wasn't. Pleasantries exchanges, no hard feelings. No one goes around ordering cards & letterhead (if he can prove that he did that) unless an offer has been made & accepted (and you don't need to have it in writing, as anyone who has taken & passed Contracts can tell you).

What she did do though was blow a perfect opportunity. So what if she thought her salary sucked. A good baby lawyer would know that he or she would have to work for peanuts for the first few months, if not year or two. It's not like they don't warn you of this in law school. Salary can always be re-negotiated, and once the lawyer has established his/her reputation in the firm & legal community, he or she can go back & re-negotiate. I've had several friends who are now very successful solos do this very thing. First they start off with a low base salary. Then they can negotiate "salary + 20% of the cases I bring in" & work up from there. Once they have their own little network of clients, they can branch out on their own.

Her comments about the low salary were stupid. However, if she was really as good on paper as she is in her own mind, another firm would have snapped her up. No one did.

new lawyers, the approach would have been to say that the offer is substantially lower than the local going rate (and she'd better be willing to kiss that job goodbye) -- and to do that verbally, where you could feel out the response as you're making the approach. You sure as hell don't make it sound like you're Daddy's lil' rich girl and want to go on living the high life. Still wondering about the business cards, though. On my side of the street, all the real negotiating (offering and accepting) has always been initially done verbally but it's also always immediately followed up by a formal letter for the file, even if that's only a few sentences long. Did she or didn't she send him a letter (electronic or paper) saying she accepted the job? 'Cause if she didn't and she gave her word she was hiring on and then backed out because of $$, she's still a slag, but it makes him a bit of hypocrite for complaining about her being unprofessional about responding via the internet and then going on to say he's already done X, Y, and Z... because if he's going to insist on the formal paper letter first (which would be prudent), he shouldn't have done X, Y, and Z yet, anyway. Okay, my headache is coming back... :crazy:

and you could just see Buck making Keith feel better about the whole thing. Which made me understand, even more completely, why Keith was so outraged in the first place. I think KO has got himself a new campaign. :-)

I'll never forgive my mother for one thing: Arco gas stations were giving away mugs with the '69 Cubs signatures on them, in four versions.

One day, noticing the toilet wouldn't flush, I opened it up to reconnect the chain to find that my mom had put one of them, the Battery cup, signed by all the pitchers and catchers, in the toilet tank as a weight.


There's a point in every boy's life where he begins to realize that he must move beyond his relationship with his parents, to separate, and become a man. This may have been that moment for me.
