This soldier that Hackett is representing: Isn't he just a guilty as
Moussaui? Hackett claims that his client was not present at the massacre and should not be associated with the actions. But wasn't that true of Moussaui? He wasn't present at the 9/11 attack. In fact, he was in jail. How do we get away with so many double standards and spin?

1. I don't know if I'd rush to judgement, or go for moral equivalence...
... but even in the case that Hackett's client is guilty dead-to-rights, there are still things that can be said for the soldier in terms of mitigating factors, which would/could affect sentencing.

That aspect, at least, is a substantial difference from Moussaoui.

3. If you have to stretch that far to make a point ....
...maybe it's not such a good point. There's no evidence that the Haditha massacre was the result of a conspiracy which might have involved soldiers who weren't present. This soldier claims he wasn't present. If so, he's no more guilty than we all are for paying the taxes that bought the bullets that killed the people.
