Fallen Heroes Act: did Bush finally do something good?

This bill was created to stop Fred Phelps. It received massive support from both houses of Congress and was signed by the Deciderer-in-Chief a couple of days ago. It looks pretty tight--it is a prettied-up bill of attainder because no one but Phelps is picketing funerals, and it's written to stop precisely what Phelps is doing, but because it doesn't mention Phelps by name it should pass constitutional muster under the "shouting fire in a crowded theatre" concept of freedom-of-speech limitation.

Well, now we can come up with a real answer to "has Bush done anything good in his term?"

1. Phelps is a disgusting pig...
and if I saw him at my parent's funeral, it'll take a mob to stop me from squeezing his neck until it pops but this bill is just another limit to freedom.

I really doubt any judge with even the most basic, first-year law student's understanding of constitutional law would uphold it. it's a feel-good law because nobody can tolerate the idea of a disgusting creep like Phelps picketing soldiers' funerals. But where were they when he picketed gay people's funerals? Seems like Congress is pretty selective in determining where Phelps crossed the line. Can you imagine a law called "The Fallen Homosexuals Act," enacted to prevent Phelps from standing in front of gay people's funerals with their "God Hates Fags" signs? Not gonna happen.

By the way, years ago the Nazi Party held a march through the predominantly Jewish community of Skokie, IL. The ACLU defended their right to do so, and took an enormous amount of flak for it, but they were right. Even the most repellent speech is protected, and the remedy for bad speech isn't bad laws; it's more speech.

4. Phelps is an embarrassment to the right..that's why they passed the bill.
He and his little band of born-again Nazis don't try to disguise their vileness behind flag-waving and "patriotism" like the "respectable" fascists do. They aren't disagreeing with Phelps, they just don't like the way he's saying what they believe.

6. Unfortunately, the law won't stop Phelps
I heard his daughter on the radio. The law just prohibits demonstrations within 500 feet of a national cemetery. She said they are usually at least that far anyway so no big deal. :mad:

All the law did was give the hate-filled loonies a bunch of free publicity. They are eating it up. :puke:
