Marriage amendment outlaws divorce?
If there were to be a Defense of Marriage Amendment passed and it said that marriage consists of a union of one man and one woman would it outlaw divorce?

I mean, if it is only between ONE man and ONE woman, wouldn’t that prohibit marrying a second time? That would be between one man and two women (or vice versa) wouldn’t it?

Look what Texas did:
Sec. 32. (a) Marriage in this state shall consist only of the union of one man and one woman.
(b) This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.

Texas defines marriage and then forbids recognizing it. Anybody stupid enough to write hate legislation is stupid enough to write this sort of language into law.

1. ROFL. Marriage is illegal in Texas.
That's great.

2. Yeah, it is. I'm waiting for some "activist judge" to apply that
constitutional amendment. Next time some mega millionair gets divorced it just may come up in the settlement.

3. It would depend on the interpretation of One man and One woman.
I'm sure some clever, silver-tongued lawyer could interpret it that way. But even if not, this isn't so very far away from making divorce illegal, or second marriages, or marriage between interracial couples, or marriage of non-religious couples — whichever they decide to demonize next.
