TX Dems go to court to keep Delay on ballot

In a surprise twist to the Tom Delay saga, The Texas Democratic Party filed suit Thursday in an attempt to keep the resigning Republican congressman's name on the November ballot. The suit, filed in Travis County 126th District Court, seeks to undo an hours old declaration by Republican Party Chair Tina Benkiser that Delay is ineligible to run in the general election. If Delay doesn't serve as the party's candidate for the congressional district 22, then acording to the Texas Election code, no other candidate is allowed to replace him, the suit says. Lawyers for Houston's Riddle and Brazil law firm, which filed the action, obtained a temporary restraining order at about 5:10 pm from Judge Darlene Byrne. Sources familiar with the case said the order prevents Benkiser from calling a meeting of the so-called District Executive Committee or taking other measures to replace Delay as the Republican party nominee...

2. the republicans are trying to nominate another candidate to run
and we are trying to say that it has to be either Delay or nobody at this point.

3. You got to love Texas politics
This is also a good way to litigate and get political hay out of the fact that Delay used the Texas primary as a way to raise campaign contributions that he intended to use to pay legal fees. Delay defrauded his contributors and we get to use that fact to keep the gop from putting someone else on the ballot.

4. I hate to say this - this is NOT a good idea
Back in 2002, Democratic Sen. Robert Toricelli was doing poorly in his re-election run especially since there were criminal charges festering over his head. About 2-3 weeks before the November election he decided to resign from office and quit the race. Somehow (and this still shocks the bejesus out of me how they managed this one) the democrats were able to sucessful argue about why a replacement was needed at such a late time during the election. Democrats were able to get retired senator Frank Lautenberg's name on the ballot and the seat was saved.

So to be honest - let them replace DeLay. We do not what the republicans raising a stink of how the same thing was done in NJ at time period much closer to the election ESPECIALLY since it might actually make things worse with the tight race between son of former NJ repuke governor Kean and incumbant Melendez

if the Texas law says that you can't, the Repukes shouldn't be able to do so.

I am not familiar with the Texas law. But if the Dems are following the law, then probably the Repukes can't put someone on the ballot.

(rule of law . . . something you didn't hear from Repukes after 11/2000)

The Dems may have merit.

Remember, DeLay could have stepped aside before the primaries so that the Repukes could have their candidate in there. He didn't, and he won the primary. Now, he has been the "candidate", despite his legal battles. And the repukes are trying to bend the law again . . .

7. Yes but Torricelli was also the winner of his primary
and the republican's arguement was that absentee ballots had already been sent out with Torricelli's name on it.

Regardless of any shenigans that the republicans have done, one could say the same thing with what happened in New Jersey.

9. Different laws
Texas evidently has a weird law that you can't replace someone who drops out. So let them follow the law.
