Poll question: Would it be right if the US shot a terrorist like Zarqawi?
Lets say that they bombed his safehouse and he was still alive when they found him and had him in custody. Would it be ok if they just shot him right there? Is that moral/legal? Would he be a prisoner of war before being shot?

Might not be "right" but, you know what?? You STOMP on dangerous creatures when you get the chance. Kill them before they kill you. He was a waste of oxygen, a terrorist, targeting innocent people. He didn't deserve to live.

7. Treaties the U.S. signs become part of the Supreme Law of The Land
The Supreme Law of the Land is defined in the Constitution as the Constitution, itself. Treaties, like The Geneva Convention(s) become part of this supreme canon of law, an important distinction not to be overlooked.

Article VI

All debts contracted and engagements entered into, before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.

This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.

The Senators and Representatives before mentioned, and the members of the several state legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by oath or affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.


Because of this it would be unConstitutional to execute a prisoner of war in this fashion.

He's worth a lot more alive than dead, IMO. I doubt he would be worth much as far as getting other terrorists, but for insight into how they do things, where they gather, how they get equipment and money...he would be a goldmine.

in the Overall picture this is just another use of the God-Ordained Power afforded to the State. Which has been turned on americans in the past as well as innocent peoples, think Ludlow 1914, Wounded Knee 1890, The Bonus Army 1932 and more...

Zarqawi was not a Freedom Fighter (although he did do stuff to piss of the Jordanian Government) he was a killer. The argument on whether or not we had a hand in his creation or power is for another debate. Ignoring conspiracy theories of him being "Our Guy" in Iraq.

The State would argue they have no imperative to capture him instead of killing him. But, this is what a strong Federal Government is going to do for you. It will ignore "Rules of War" because the most important thing to a State is the continued existance of the State. You (the citizen) are either a plus a zero or a minus in the State's ledger.

So, the true issue is whether the people can unring the bell of Imperalism. Over the last 225 years Imperalism has won and continues to strangle the opposition.

20. it would be understandable why someone would shoot him but....
...it's probably much better to take him alive for many reasons. here are just a few:

1) by killing him he becomes a martyr and his followers come back 10 times harder and more violent against the "infidels".

2) by imprisoning him and showing photos of him in the orange jumpsuit in jail he's less of a hero to potential terrorists. instead he just looks like another criminal.

3) by keeping him alive there's always the hope he will be a source of information used to identify real terror cells in the future.
