What is a sealed affidavit?
and what are the implications of the sealed affidavits filed in the Libby Case? Also, what are protective orders? Who are they protecting? Thanks. DYEW



In other Libby news, Patrick Fitzgerald has asked to file a sealed affidavit in response to Libby lawyer Ted Well's sealed affidavit of April 12, referenced in Libby's April 12 Reply (pdf) regarding his Third Motion to Compel (Discussed at length here.) As I noted here in discussing Ari Fleischer, according to Footnote 4 on page 14, Well's affidavit discusses why the material Libby is requesting about Ari Fleischer is material to the defense.

The affidavits were filed under seal pursuant to the Court's Nov. 23 protective order. The court issued two protective orders that day, one applicable to classified information and one applicable to grand jury testimony and discovery documents with personal privacy information.

A hearing on the third motion to compel is set for May 5.

1. an affidavit typically is a statement of fact....a witness' testimony etc.
or a summary of an investigtion....

that can be sealed by court order.

it could be concealed, for example, because revealing its contents could compromise an investigation in some way ... cause witnesses or suspects to flee, or cause someone to destroy evidence, etc.

there's more to it but i think that's the basic idea..

3. I would imagine
a summary of an investigtion would be a very interesting item in an investigation like this.

I found a recent reference to a sealed affidavit in the William Jefferson case. The darn thing was 83 pages long and contained all the gory details of the case.

2. Affivdavits are like statements. They are signed dated and notarized
If they are sealed that means the general public can't see them. Protective orders can cover a lot of issues.

5. No need to welcome. I'm an oldie, but that's a long story. Anyway
Protective orders in the Libby case could be about not being allowed to depose witnesses to not being able to view documents. Its hard to say. But with the level of people involved here you can guess that national security would come into play at some point.

it's an uh affidavit

and it uh has uh been sealed

so uh if you uh want to look at it, uh you can't uh because uh it's sealed

uh and uh it's clear to everyone uh that it's an affidavit uh inside the sealed part of the uh sealed affidavit

you see, affidavits are important documents that we uh need because they're important
