Court: 1st Amendment Doesn't Shield Author

<snip>
"The First Amendment does not bar the government from putting the lie to a defendant's proof at sentencing," the appeals court wrote.

<snip>
The government presented excerpts from Kane's books. One title, "Mastering the Art of Male Supremacy: Training Techniques for the Home Front," suggested refraining from "real violence" but advocated disciplining wives with "a rolled up newspaper on the rump once in a while."

Kane also weighed in on how to manipulate financial records to qualify for subsidized housing, how to run a fraudulent mail order scheme to offer a service that doesn't exist and how to avoid a sexual harassment lawsuit while displaying pictures of topless women in the office.

The appeals court said the lower court judge properly concluded that Kane's published advice on running real estate and mail order schemes undercut his professed honesty and his guide to male supremacy "tempered the sincerity of his spousal devotion."
<snip>

Justice was correctly served up to this Scumbag. Of course, his lawyer claims he just has a sense of humor. :eyes: (last paragraph of piece)

1. I have no problem with the how-to-commit-fraud bits...
being used to justify sentencing in a fraud case. But the rest of it should've been excluded. No matter how onerous the material, the First Amendment exists to protect everyone.
