Isn't The NSA Bill An Ex Post Facto Law???
And thus Unconstitutional??

Just wonderin'.

An ex post facto law to legalize prezidential behavior that has not even been defined or investigated

(since had it been defined, it would be established as a high crime or at minimum an abuse of power, comparable to Lincoln's breach of habeas corpus or Roosevelt's detention of US citizens.)

Leaving aside the gag issue for a moment, Congress does not have the constitutional power to pardon a sitting president for illegal actions after the fact.

2. ex post facto doesn't refer to retroactive LEGALization
it refers to retroactively making things ILlegal.

Retroactive legalization of a crime that could only be committed by certain individuals is the power to pardon an individual thru legislation. Nowhere in the Constitution does Congress have that right.
