Kennedy and Leahy Ask Gonzales for Information on Criminal Cases Involving Warrantless Wiretapping

* NSA PROGRAM UNDERCUTS NATIONAL SECURITY BY ENCOURAGING CHALLENGES IN THE PROSECUTION OF TERRORISTS *

Washington, DC: Today Senate Judiciary members Edward M. Kennedy and Patrick Leahy sent a letter to Attorney General Gonzales requesting information on cases involving warrantless wiretapping. The Judiciary Committee is continuing its hearings on the NSA program – a program that Senator Kennedy believes undercuts our national security by making it more difficult to prosecute terrorists and puts our front line national security employees at risk.

About his request to the Attorney General, Senator Kennedy said, “The President jeopardizes all of us when he ignores the law in national security cases. His rejection of well-established laws on surveillance is causing serious uncertainty in the courts. Tainted evidence obviously has grave consequences for the prosecution of terrorists. The Administration keeps taking us down this slippery slope, and it’s long past time to change course.“

Dear Attorney General Gonzales:

According to press accounts, several terrorism defendants have filed legal challenges to the President’s program of electronic surveillance of Americans without a warrant. These include Ali al-Timimi, a Virginia Islamic scholar convicted of inciting his followers to train for violent jihad, and Iyman Faris, an Ohio truck driver convicted of plotting with al Qaeda to bring down the Brooklyn Bridge. In addition, a federal judge postponed sentencing Ahmed Omar Abu Ali, a Virginia man convicted of conspiring to assassinate President Bush, pending further assurance by the government that no information used against him was obtained through warrantless surveillance.

1. So the hearings WILL continue?
I heard Specter say he wanted to call Torquemada in for another round -- can't wait for that (if it happens). More ammo for Feingold ...
